                                    HOUSE BILL NO. 215

                             BY HEALTH AND WELFARE COMMITTEE

 1                                        AN ACT
 2    RELATING TO LICENSURE BY THE BOARD  OF  MEDICINE;  AMENDING  SECTION  54-1810,
 3        IDAHO  CODE,  TO  PROVIDE THAT A PERSONAL INTERVIEW MAY BE REQUIRED BY THE
 4        BOARD AND TO MAKE TECHNICAL CORRECTIONS;  AND  AMENDING  SECTION  54-1811,
 5        IDAHO  CODE,  TO  PROVIDE THAT A PERSONAL INTERVIEW MAY BE REQUIRED BY THE
 6        BOARD AND TO MAKE TECHNICAL CORRECTIONS.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION 1.  That Section 54-1810, Idaho Code, be, and the same  is  hereby
 9    amended to read as follows:

10        54-1810.  LICENSURE  BY  WRITTEN  EXAMINATION.  (1)  Any person
11    seeking to be licensed to practice medicine and surgery or  osteopathic  medi-
12    cine  or osteopathic medicine and surgery in this state must successfully com-
13    plete the following requirements before a license will be issued:
14        ( a  1 )  Each applicant  must  submit  a  completed
15    written  application  to the board on forms furnished by the board which shall
16    require proof of graduation from a medical school acceptable to the board  and
17    successful  completion  of  a    post-graduate    postgraduate
18     training program acceptable to the board.
19        ( b  2 )  Each applicant must  pass  an  examination
20    conducted  by  or  acceptable  to  the  board  which shall thoroughly test the
21    applicant's fitness to practice medicine. If an applicant fails  to  pass  the
22    examination  on  two  (2) separate occasions, he shall not be eligible to take
23    the examination for at least one (1) year, and before taking  the  examination
24    again, he must make a showing to the board that he has successfully engaged in
25    a  course  of  study for the purpose of improving his ability to engage in the
26    practice of medicine. Applicants who fail two  (2)  separate  examinations  in
27    another  state,  territory,  or  district of the United States or Canada, must
28    make the same showing of successful completion of a course of study  prior  to
29    examination for licensure.
30        (  c    3  )    Each   The board may
31    require an  applicant  shall   to   be  personally
32    interviewed  by  the  board  or a designated committee of the board.  The

34    limited  to  a  review  of  the applicant's quali-
35    fications and professional credentials.

36        SECTION  2.  That  Section 54-1811, Idaho Code, be, and the same is hereby
37    amended to read as follows:

38        54-1811.  LICENSURE BY ENDORSEMENT. Any person seeking to be  licensed  to
39    practice  medicine  in  this  state  who  is  licensed to practice medicine in
40    another state must successfully complete the following requirements  before  a
41    license to practice medicine will be issued:

 1        (1)  Each  applicant  must  submit  a completed written application to the
 2    board on forms furnished by the board which shall require proof of  graduation
 3    from  a  medical school acceptable to the board and successful completion of a
 4     post-graduate   postgraduate  training program  accept-
 5    able  to  the  board  and  which contains proof that the applicant has any one
 6     (1)  of the following qualifications:
 7        (a)  The applicant is a diplomate of the national board of medical examin-
 8        ers or the national board of examiners for osteopathic physicians and sur-
 9        geons;
10        (b)  The applicant holds a valid, unrevoked, unsuspended license to  prac-
11        tice medicine and surgery, or osteopathic medicine and surgery in a state,
12        territory  or  district  of the United States or Canada, and the applicant
13        demonstrates that he possesses the requisite qualifications to provide the
14        same standard of health care as provided by licensed  physicians  in  this
15        state.  The board may require further examination to establish such quali-
16        fications.
17        (2)   Each   The board may  require  an    applicant
18     shall   to  be personally interviewed by the board or a
19    designated  committee  of  the  board.  The interview shall be  conducted
20      limited  to  a    review    of    the
21    applicant's qualifications and professional credentials.

The purpose of this legislation is to change the current statutory
requirement of a personal interview for all applicants for medical
licensure to the requirement that a personal interview may be required
by the Board.






                                                                    FISCAL NOTE 

There will be no fiscal impact on licensure fees and the  dedicated fund.
