H0217|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 217 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO MAXIMUM GROSS WEIGHT OF VEHICLES; AMENDING SECTION 40-511, IDAHO 3 CODE, TO INCREASE THE MAXIMUM GROSS WEIGHT GOVERNING THE REQUIREMENT THAT 4 A VEHICLE MUST STOP FOR INSPECTION. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 40-511, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 40-511. STOPPING AND INSPECTION. (1) Wherever by the laws of the state of 9 Idaho any vehicle with a maximum gross weight ofeighteen10 twenty-six thousand one (1826 11 ,0001 ) pounds or more, excepting those trans- 12 porting livestock or placardable quantities of hazardous materials, is used to 13 transport any merchandise, product or commodity within the state, within the 14 state to without the state, or from without the state to within the state, the 15 owner or operator of either the motor vehicle or trailer, as defined in chap- 16 ter 1, title 49, Idaho Code, used to transport such merchandise, product or 17 commodity is hereby required to stop at such ports of entry or checking sta- 18 tions established by the Idaho transportation department and submit to inspec- 19 tion, grading or weighing, for compliance with the laws of the state of Idaho. 20 (2) Vehicles or combinations of vehicles with a maximum gross weight of 21 ten thousand (10,000) pounds or more transporting livestock or placardable 22 quantities of hazardous materials are required to stop at all ports of entry 23 or checking stations established by the Idaho transportation department. 24 (3) It shall be the duty of such owner or operator of every motor vehicle 25 or trailer to drive the motor vehicle or trailer upon any state owned station- 26 ary or portable scale or private scale, certified by the state of Idaho when 27 requested to do so by any peace officer, excepting fish and game officers, or 28 authorized employees of the Idaho transportation department. 29 (4) Authorized employees of the transportation department may stop any 30 vehicle with a maximum gross weight of eighteen thousand (18,000) pounds or 31 more by displaying a flashing red light if the authorized employee has proba- 32 ble cause to believe the vehicle bypassed a weighing or inspection station or 33 proceeded through the station without regard for the directional signals. 34 Authorized employees may direct a vehicle which has bypassed a weighing or 35 inspection station or has proceeded through the station without regard for the 36 directional signals, to return to the bypassed inspection or weighing station 37 and may issue a citation for failure to stop as required in this section. The 38 operator of a vehicle shall bring the vehicle to a stop, pulling off the 39 traveled portion of the highway when directed to do so by an authorized 40 employee of the transportation department by use of emergency lights or siren.
STATEMENT OF PURPOSE RS 08752C1 The purpose of this legislation is to raise the maximum gross weight from 18,000 pounds to 26,001 pounds or more required to stop at ports of entry and checking stations. FISCAL NOTE This bill would cost the Transportation Department $18,000.00 for new signs at the ports of entries.
