 1                                        AN ACT
 2    RELATING TO VETERANS MOTOR VEHICLE LICENSE PLATES;  AMENDING  SECTION  49-402,
 3        IDAHO  CODE, TO PROVIDE CORRECT REFERENCES AND TO CLARIFY DEPOSIT OF REVE-
 4        NUES FROM SPECIAL LICENSE PLATE PROGRAMS; AMENDING SECTION  49-418,  IDAHO
 5        CODE,  TO INCREASE THE PROGRAM FEE FOR VETERANS LICENSE PLATES, TO PROVIDE
 6        FOR SAMPLE VETERANS PLATES AND TO PROVIDE THAT  VEHICLES  DISPLAYING  VET-
 7        ERANS  LICENSE PLATES SHALL BE ALLOWED TO ENTER STATE PARKS AND RECREATION
 8        SITES WITHOUT PAYMENT OF ANY ENTRANCE FEES;  AND  PROVIDING  AN  EFFECTIVE
 9        DATE.

10    Be It Enacted by the Legislature of the State of Idaho:

11        SECTION  1.  That  Section  49-402, Idaho Code, be, and the same is hereby
12    amended to read as follows:

13        49-402.  ANNUAL REGISTRATION. (1) The annual fee for operating each pickup
14    truck and each other motor vehicle having a maximum gross weight not in excess
15    of eight thousand (8,000) pounds, designed for the purpose of carrying passen-
16    gers and not used for hire shall be:
17        Vehicles one (1) and two (2) years old ............................ $48.00
18        Of the registration fees collected for vehicles one (1) and two (2)  years
19        old,  $36.48  shall  be  deposited to the highway distribution account and
20        $11.52 shall be deposited to the restricted highway fund.
21        Vehicles three (3) and four (4) years old ......................... $36.00
22        Of the registration fees collected for vehicles three  (3)  and  four  (4)
23        years  old,  $33.48 shall be deposited to the highway distribution account
24        and $2.52 shall be deposited to the restricted highway fund.
25        Vehicles five (5) and six (6) years old ........................... $36.00
26        Of the registration fees collected for vehicles five (5) and six (6) years
27        old, $26.28 shall be deposited to the  highway  distribution  account  and
28        $9.72 shall be deposited to the restricted highway fund.
29        Vehicles seven (7) and eight (8) years old ........................ $24.00
30        Of  the  registration  fees collected for vehicles seven (7) and eight (8)
31        years old, $22.68 shall be deposited to the highway  distribution  account
32        and $1.32 shall be deposited to the restricted highway fund.
33        Vehicles over eight (8) years old ................................. $24.00
34        Of  the registration fees collected for vehicles over eight (8) years old,
35        $16.08 shall be deposited to the highway distribution  account  and  $7.92
36        shall be deposited to the restricted highway fund.
37        There  shall  be twelve (12) registration periods, starting in January for
38    holders of validation registration stickers numbered 1, and proceeding consec-
39    utively through December for holders of validation registration stickers  num-
40    bered  12,  each of which shall start on the first day of a calendar month and
41    end on the last day of the twelfth month from the first day of  the  beginning
42    month.  Registration periods shall expire midnight on the last day of the reg-
43    istration period  in  the  year  designated  by  the  validation  registration

 1    sticker.  The  numeral digit on the validation registration stickers shall, as
 2    does the registration card, fix the registration period  under  the  staggered
 3    plate  system of Idaho for the purpose of reregistration and notice of expira-
 4    tion.
 5        A vehicle that has once been registered for any of  the  above  designated
 6    periods  shall,  upon reregistration, be registered for the period bearing the
 7    same number, and the registration card shall show and be the  exclusive  proof
 8    of  the  expiration  date  of registration and licensing. Vehicles may be ini-
 9    tially registered for less than a twelve (12) month period, or for more than a
10    twelve (12) month period, and the fee prorated on a monthly basis if the frac-
11    tional registration tends to fulfill the purpose of the monthly series  regis-
12    tration system.
13        (2)  For all motor vehicles equipped to carry passengers and operated pri-
14    marily  for  hire  exclusively  within  the limits of an incorporated city and
15    adjacent thereto, when the service outside the city is a  part  of  a  regular
16    service  rendered  inside  the city, and for school buses operated either by a
17    nonprofit, nonpublic school or operated pursuant to a service contract with  a
18    school  district  for transporting children to or from school or in connection
19    with school approved activities, the annual fee shall be  twelve  dollars  and
20    forty-eight cents ($12.48).
21        (3)  For  all  hearses,  ambulances  and  wreckers the annual fee shall be
22    twenty-nine dollars and forty cents ($29.40), and these  vehicles  shall  bear
23    passenger  car plates. No operator of a hearse, ambulance, or wrecker shall be
24    entitled to operate them by virtue of any dealer's license that may have  been
25    issued under the provisions of this chapter.
26        (4)  For all motorcycles and  all-terrain vehicles the annual fee shall be
27    nine dollars ($9.00). For operation of an ATV off the public highways, the fee
28    specified  in  section  67-7122,  Idaho Code, shall also be paid. Registration
29    exemptions provided in section 49-426(2), Idaho  Code,  apply  to  all-terrain
30    vehicles  and  motorcycles  used for the purposes described in that subsection
31    (2).
32        (5)  For all motor homes the fee shall be as specified in  subsection  (1)
33    of  this  section and shall be in addition to the fees provided for in section
34    49-445, Idaho Code.
35        (6)  Registration fees shall not be subject to refund.
36        (7)  A financial institution  or  repossession  service  contracted  to  a
37    financial  institution  repossessing  vehicles  under  the terms of a security
38    agreement shall move the vehicle from the place of repossession to the  finan-
39    cial institution's place of business on a repossession plate. The repossession
40    plate  shall  also be used for demonstrating the vehicle to a prospective pur-
41    chaser for a period not to exceed ninety-six (96) hours. The registration fees
42    for repossession plates shall be as required in subsection (1) of this section
43    for a vehicle one (1) and two (2) years old. All  other  fees  required  under
44    chapter 4, title 49, Idaho Code, shall be in addition to the registration fee.
45    The repossession plate shall be issued on an annual basis by the department.
46        (8)  In  addition  to  the  annual registration fee in this section, there
47    shall be an initial program fee of twenty-five dollars ($25.00) and an  annual
48    program fee of fifteen dollars ($15.00) for all special license plate programs
49    for  those license plates issued pursuant to sections 49-404A, 49-407, 49-408,
50    49-409, 49-414 ,   and  49-416 ,     and
51    49-418,    Idaho  Code.  For  special plates issued pursuant to sections
52    49-406 and 49-406A, Idaho Code, there shall  be  an  initial  program  fee  of
53    twenty-five  dollars  ($25.00)  but there shall be no annual  renewal fee. For
54    special plates issued pursuant to sections 49-417 and 49-417A,    49-418,
55    49-419 and 49-420,  Idaho Code, there shall be an initial program fee of

 1    thirty-five  dollars ($35.00) and an annual program fee of twenty-five dollars
 2    ($25.00).  For special plates issued pursuant to section  49-418A,  Idaho
 3    Code,  the  initial program fee and the annual renewal fee shall be fifty dol-
 4    lars ($50.00).  The fees contained in this subsection shall be  applica-
 5    ble  to all new special plate programs. The initial program fee and the annual
 6    program fee shall be deposited  in the state highway account and shall be
 7    used to fund the cost of administration  of  special  license  plate  programs
 8    which  are  provided  to  the public as a personal alternative to the standard
 9    license plate requirements   as specified by law for  each  program
10    .

11        SECTION  2.  That  Section  49-418, Idaho Code, be, and the same is hereby
12    amended to read as follows:

13        49-418.  VETERANS PLATES. (1) Any person who is the  owner  of  a  vehicle
14    registered  under  the  provisions of section 49-402 or 49-434(1), Idaho Code,
15    may apply for and upon department approval receive  special  veterans  license
16    plates in lieu of regular license plates. The provisions of this section shall
17    not  apply  to any vehicle with a registered maximum gross weight over sixteen
18    thousand (16,000) pounds. Availability of veterans plates for  other  vehicles
19    shall be subject to the rules, policies and procedures of the department.
20        (2)  Proof  of being a current or former member of the United States armed
21    forces must be furnished to the department before special veterans plates will
22    be issued. Acceptable proof shall be a copy of form  DD214  or  an  equivalent
23    document or statement from the department of veterans affairs.
24        (3)  In  addition  to  the  regular  registration fees required in section
25    49-402(1) or 49-434(1), Idaho Code, the applicant shall  pay the  initial
26    program  fee  and the annual program fee specified in section 49-402(8), Idaho
27    Code, and the plate fee specified in section 49-450, Idaho Code    
28    be  charged  a fee of thirty-five dollars ($35.00) for the initial issuance of
29    the plates, and twenty-five dollars ($25.00) upon each succeeding annual  reg-
30    istration. Twenty-five dollars ($25.00) of the initial fee and fifteen dollars
31    ($15.00)  of  the  renewal fee shall be deposited in the state highway account
32    and shall be used to fund the cost of administration of this  special  license
33    plate  program.  Ten  dollars  ($10.00)  of  each  initial fee and ten dollars
34    ($10.00) of each renewal fee shall be deposited by the state treasurer in  the
35    park  and  recreation fund established in section 67-4225, Idaho Code, for use
36    in the maintenance of parks and facilities .
37        (4)  Whenever title or interest in a vehicle registered under  the  provi-
38    sions  of  this section is transferred or assigned, the owner may transfer the
39    special plates to another vehicle upon payment of the required transfer  fees.
40    The  owner  may only display the plates on another vehicle upon receipt of the
41    new registration from the department.
42        (5)  The veterans license plate design shall include the colors red, white
43    and blue, shall designate one (1) of the five (5) branches  of  military  ser-
44    vice, and display either:
45        (a)  The word "VETERAN" or
46        (b)  The  name of a conflict or war period recognized by the United States
47        department of veterans affairs for the purpose of  awarding  federal  vet-
48        erans benefits as defined in 38 U.S.C. 101(11).
49    The license plate design shall comply with all applicable rules of the depart-
50    ment,  and shall include a separate and distinct numbering system. The design,
51    color, and numbering system shall be subject to approval of the department.
52         (6)  Sample veterans plates may be purchased from the department for
53    a fee of thirty dollars ($30.00), twelve dollars ($12.00) of  which  shall  be

 1    deposited  in the state highway account and eighteen dollars ($18.00) of which
 2    shall be deposited by the state treasurer in the park and recreation fund  for
 3    use in the maintenance of parks and facilities.
 4        (7)  Vehicles  displaying  a  veterans  license  plate shall be allowed to
 5    enter state parks and recreation sites without payment of any entrance fee  or
 6    parking  fee, but any additional fees which may be required for use of facili-
 7    ties within the state park or recreation site shall not be waived. 

 8        SECTION 3.  This act shall be in full force and effect on and after  Janu-
 9    ary 1, 2000.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS09027

The intent of this bill is to promote the use of the Veterans'
License Plates, further exemplifying their service to our country,

                           FISCAL NOTE

The $10 increase to those who choose to use the plates will go to
the Parks and Recreation Department as an expense offset. No fiscal
