                         BY RESOURCES AND CONSERVATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE BOARD OF SCALING PRACTICES; AMENDING  SECTION  38-1203,  IDAHO
 3        CODE, TO ADD A FIFTH MEMBER TO THE BOARD OF SCALING PRACTICES TO REPRESENT
 4        NONINDUSTRIAL PRIVATE FOREST LANDOWNERS AND TO MAKE TECHNICAL CORRECTIONS.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Section 38-1203, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        38-1203.  STATE BOARD OF SCALING PRACTICES -- MEMBERS -- TERMS. A board to
 9    be known as the "state board of scaling practices" is hereby  created  in  the
10    department  of  lands.  It  shall consist of the director of the department of
11    lands and  four   five  ( 4   5  )
12    members appointed by the governor from among nominees recommended by the orga-
13    nized and generally recognized forest industry associations  or individu-
14    als  representing  nonindustrial private forest landowners  provided not
15    less than two (2) board members be appointed from the  Idaho  forest  industry
16    council, and not less than two (2) board members be appointed from the associ-
17    ated logging contractors of Idaho, inc., each association to have one (1) mem-
18    ber from north of the Salmon river and one (1) member from south of the Salmon
19    river.    One (1) member shall be appointed to represent the interests of
20    nonindustrial private forest landowners  throughout  the  state.  That  person
21    shall  be  chosen  from  nominees provided to the governor by the Idaho forest
22    owner's association. The  person  representing  nonindustrial  private  forest
23    landowners  shall own not less than one hundred (100) nor more than five thou-
24    sand (5,000) acres of private forest land and shall not own or control a  for-
25    est products manufacturing facility within the state. In choosing this person,
26    the  governor  shall give preference to persons with a demonstrated history of
27    selling timber or logs to a variety of purchasers and who have scaling or for-
28    est management experience.  The members of  the  board  shall  have  the
29    qualifications  required  by  section  38-1204, Idaho Code. The members of the
30    board shall be appointed for a three (3) year term. Each member of  the  board
31    shall  take,  subscribe  and file the oath required by sections 59-401 --
32      through  59-408,  Idaho  Code,  before  entering  upon  the
33    duties  of  his  office.  On  the  expiration of the term of any member ,
34     his successor shall be appointed in like manner by the governor  for  a
35    term  of three (3) years and unexpired terms shall be filled for the unexpired
36    balance of the term.

                       STATEMENT OF PURPOSE
                                 
                              RS08796The purpose of this legislation is to add a fifth member to the now
existing four member Scaling Board. The fifth member would
represent forest owners who have no inherent ties to the Forest
Products Industry. The fifth member would be an owner of 5000 acres
or less. The fifth member would be an active seller of wood
products for market and an active participant in tree farming.
