WORKER'S COMPENSATION - Amends existing law to provide that the statutes on
worker's compensation insurance rates shall apply as to any insurance on
hazards or perils of its subscribers outside a single industry written by a
domestic reciprocal insurer transacting worker's compensation insurance
only and insuring solely the hazards or perils of its subscribers
associated with a single industry.

                       HOUSE BILL NO. 267, As Amended in the Senate

 1                                        AN ACT
 2    RELATING TO WORKER'S COMPENSATION INSURANCE RATES; AMENDING  SECTION  41-1601,
 3        IDAHO  CODE,  TO PROVIDE THAT THE STATUTES ON WORKER'S COMPENSATION INSUR-
 4        ANCE RATES SHALL APPLY TO ANY INSURANCE ON HAZARDS OR PERILS OF  ITS  SUB-
 5        SCRIBERS  OUTSIDE  A  SINGLE  INDUSTRY  WRITTEN  BY  A DOMESTIC RECIPROCAL
 6        INSURER TRANSACTING WORKER'S  COMPENSATION  INSURANCE  ONLY  AND  INSURING
 7        SOLELY  THE  HAZARDS OR PERILS OF ITS SUBSCRIBERS ASSOCIATED WITH A SINGLE
 8        INDUSTRY AND TO MAKE TECHNICAL CORRECTIONS.

 9    Be It Enacted by the Legislature of the State of Idaho:

10        SECTION 1.  That Section 41-1601, Idaho Code, be, and the same  is  hereby
11    amended to read as follows:

12        41-1601.  SCOPE OF CHAPTER. (1) This chapter applies as to  workmen's
13        worker's    compensation  insurance as defined in section
14    41-506(1)(d),  Idaho Code,  and to insurance or guaranty by  surety
15    insurers  of  the  obligations of employers under  Workmen's  
16    worker's   C  c ompensation  L   l
17    aws.
18        (2)  This  chapter  shall  not apply as to any domestic reciprocal insurer
19    transacting  workmen's   worker's   compensation  insur-
20    ance  only and insuring solely the hazards or perils of its subscribers exclu-
21    sively associated with a single industry.  However, if  such  a  domestic
22    reciprocal  insurer  transacting  worker's  compensation  insurance  wishes to
23    insure hazards or perils outside a single industry, insurance written on  such
24    different hazards shall be subject to the provisions of this chapter.

                             SENATE AMENDMENT TO H.B. NO. 267

 1                                AMENDMENT TO SECTION 1
 2        On page 1 of the printed bill, in lines 16 and 17, delete " .  
 3      exclusively  associated  with  a  single  industry. " and insert:
 4    "exclusively associated with a single  industry.    However,  if  such  a
 5    domestic reciprocal insurer transacting worker's compensation insurance wishes
 6    to  insure  hazards  or perils outside a single industry, insurance written on
 7    such different hazards shall be subject to the  provisions  of  this  chapter.
 8    ".

 9                                 CORRECTION TO TITLE
10        On  page  1, in line 4, delete "NOT", also in line 4, delete "AS" and also
11    in line 4, following "ANY" insert: "INSURANCE  ON HAZARDS  OR  PERILS  OF  ITS
12    SUBSCRIBERS  OUTSIDE A SINGLE INDUSTRY WRITTEN BY A"; and in line 6, following
13    "SUBSCRIBERS" insert: "ASSOCIATED WITH A SINGLE INDUSTRY".

Statement of Purpose / Fiscal Impact


                         STATEMENT OF PURPOSE

                               RS 08964

The purpose of this legislation is to allow domestic reciprocal worker's
compensation insurers who are involved in only one specific industry to
write worker's compensation insurance outside of the single industry
without losing the exemption provided in Idaho Code 41-1601.







                             FISCAL NOTE

The passage of this legislation will have no negative fiscal effect on
