 1                                        AN ACT
 2    RELATING TO TRANSFER OF ACCRUED SICK LEAVE; AMENDING  SECTION  67-5335,  IDAHO
 3        CODE,  TO  AUTHORIZE AN OFFICER OR EMPLOYEE TO TRANSFER ACCRUED SICK LEAVE
 4        TO OR FOR THE USE OF ANOTHER OFFICER OR EMPLOYEE IN THE EVENT THE  RECEIV-
 5        ING  OFFICER OR EMPLOYEE OR A FAMILY MEMBER SUFFERS FROM A SERIOUS ILLNESS
 6        OR INJURY IF THE BALANCE OF THE LEAVE PROPOSED TO BE  TRANSFERRED  BY  THE
 7        EMPLOYEE EXCEEDS EIGHTY HOURS.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION  1.  That  Section 67-5335, Idaho Code, be, and the same is hereby
10    amended to read as follows:

11        67-5335.  VACATION TIME -- ELIGIBILITY -- MAXIMUM TIME -- RIGHT TO  ANNUAL
12    VACATION. (1) An appointing authority shall permit each officer or employee to
13    take vacation leave to the extent such leave has accrued.
14        (2)  Vacation leave may be accrued and accumulated only as follows, unless
15    amounts  in  excess  of the permitted accumulations have been expressly autho-
16    rized in writing by the board of examiners during unusual or emergency  situa-
17    tions:
18        During  the  first  ten  thousand  four hundred (10,400) hours of credited
19    state service, vacation leave may be accrued and accumulated to a  maximum  of
20    one hundred ninety-two (192) hours;
21        During  the  second  ten  thousand four hundred (10,400) hours of credited
22    state service, vacation leave may be accrued and accumulated to a  maximum  of
23    two hundred forty (240) hours;
24        During  the  third  ten  thousand  four hundred (10,400) hours of credited
25    state service, vacation leave may be accrued and accumulated to a  maximum  of
26    two hundred eighty-eight (288) hours;
27        After  thirty-one  thousand  two  hundred (31,200) hours of credited state
28    service, vacation leave may be accrued and accumulated to a maximum  of  three
29    hundred thirty-six (336) hours.
30        (3)  Vacation  leave  shall  be transferable from department to department
31    only to the extent that it is accrued and accumulated.
32        (4)  Vacation leave shall not be earned, accrued or accumulated during any
33    pay period in which the maximum accruals and accumulations  provided  by  this
34    section have been met.
35        (5)  Vacation leave not taken shall be compensated for at the time of sep-
36    aration  only  to  the maximum accruals and accumulations allowed by this sec-
37    tion.
38        (6)  Vacation leave shall be taken on a workday basis. Regularly scheduled
39    days off and officially designated holidays falling within a period  of  vaca-
40    tion  leave  shall not be counted against vacation leave. Vacation leave shall
41    not be taken in advance of being earned and shall only be taken in pay periods
42    subsequent to being earned.
43        (7)  With the approval of the appointing authority for both the  transfer-

 1    ring  and  receiving  officer or employee, an officer or employee may transfer
 2    accrued vacation leave  or sick leave , up to a  maximum  of  forty
 3    (40)  hours per fiscal year, to  or for the use of  another officer
 4    or employee for purposes of sick leave in the event the receiving  officer  or
 5    employee  or  a  family  member  suffers from a serious illness or injury. The
 6    amount transferred shall be converted to sick leave. An  officer  or  employee
 7    shall  not  be  allowed to receive more than one hundred  sixty (160) hours of
 8    transferred leave per fiscal year, and a transfer shall not  occur  until  the
 9    receiving  employee  has exhausted all of his or her accrued sick and vacation
10    leave. An officer or employee shall not be eligible to transfer vacation leave
11     or sick leave  unless his or her balance  of the  leave  pro-
12    posed  to be transferred  exceeds eighty (80) hours, and in no event may
13    an officer or employee transfer an amount of accrued leave which would  result
14    in an accrued balance of less than eighty (80) hours.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS 08926

In 1998 a policy was put in place allowing employees to contribute
earned vacation leave to other employees who had exhausted their
sick and vacation leave due to catastrophic circumstances they
cannot control. This legislation is intended to extend to state
employees the ability to transfer accrued sick leave time to other
employees as they are now able to transfer accrued vacation time.
Over 3,000 hours of vacation leave have been transferred to help
state employees since this law became effective.




                           FISCAL NOTE

Cost to the State is difficult to assess since sick leave value is
heavily restricted, but is anticipated to be minimal. Benefits to
employees is expected to offset any impact due to movement of sick
leave time.
