 1                                        AN ACT
 2    APPROPRIATING MONEYS TO THE PUBLIC UTILITIES COMMISSION FOR FISCAL YEAR  2000;
 3        LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; TRANSFERRING MONEYS
 4        TO  THE GENERAL FUND; APPROPRIATING ADDITIONAL MONEYS TO THE PUBLIC UTILI-
 5        TIES COMMISSION FOR FISCAL YEAR 1999; AND DECLARING AN EMERGENCY FOR  SEC-
 6        TION 4 OF THIS ACT.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION  1.  There  is hereby appropriated to the Public Utilities Commis-
 9    sion the following amount, to be expended for the designated programs  accord-
10    ing  to  the  designated  expense classes from the listed funds for the period
11    July 1, 1999, through June 30, 2000:

30        SECTION 2.  In accordance with Section 67-3519,  Idaho  Code,  the  Public
31    Utilities  Commission  is  authorized  no  more  than fifty-six (56) full-time
32    equivalent positions at any point during the period July 1, 1999, through June
33    30, 2000, for the programs specified in Section 1 of this act, unless specifi-
34    cally authorized by the Governor. The Joint  Finance-Appropriations  Committee
35    will be notified promptly of any increased positions so authorized.

36        SECTION  3.  Notwithstanding  any other provisions of law, there is hereby
37    appropriated from the Public Utilities Commission Fund and transferred to  the
38    General  Fund  an  amount equal to the General Fund expenditures of the Public
39    Utilities Commission for the period July 1, 1999, through June 30, 2000.

40        SECTION 4.  In addition to the appropriation made in  Section  1,  Chapter

 1    86, Laws of 1998, there is hereby appropriated to the Public Utilities Commis-
 2    sion  the  following  amount,  to  be  expended for the Administration Program
 3    according to the designated expense class from the listed fund for the  period
 4    July 1, 1998, through June 30, 1999:

 9        SECTION  5.  An  emergency  existing  therefor,  which emergency is hereby
10    declared to exist, Section 4 of this act shall be in full force and effect  on
11    and after its passage and approval.

Statement of Purpose / Fiscal Impact



                                        STATEMENT OF PURPOSE

                                               HB 374

This is the fiscal year 2000 appropriation for the Public Utilities Commission in the
amount of $4,412,900.   The RS limits the number of  positions to 56.  It also provides
that, at year end, an amount equal to the General Fund expenditures for commissioner
compensation be transferred from the Public Utilities Commission Fund to the General
Fund.  Section 4 provides an FY 1999 supplemental in the amount of $8,800 for
commissioner separation pay for earned but untaken vacation time for a departing
Commissioner. (Note:  Another supplemental for $11,300 was approved early in the
session). Section 5 declares an emergency for the supplemental.
