 2    RELATING TO THE APPROPRIATION FOR PUBLIC SCHOOL SUPPORT FOR FISCAL YEAR  2000;
 3        EXPRESSING  LEGISLATIVE  INTENT  WITH  REGARD  TO  EXPENDITURES FROM STATE
 4        SOURCES; APPROPRIATING GENERAL FUND MONEYS  FOR  TRANSFER  TO  THE  PUBLIC
 5        SCHOOL  INCOME  FUND;  APPROPRIATING A TOTAL AMOUNT FROM THE PUBLIC SCHOOL
 6        INCOME FUND; APPROPRIATING MONEYS FOR THE UNEMPLOYMENT INSURANCE  PROGRAM;
 7        AMENDING  SECTION  33-1004E,  IDAHO  CODE, TO INCREASE THE BASE SALARY FOR
 8        SALARY-BASED APPORTIONMENT AND TO MAKE A TECHNICAL  CORRECTION;  PROVIDING
 9        THAT  THE  STATE  DEPARTMENT  OF  EDUCATION  SHALL HAVE CERTAIN AUTHORITY;

20        CREATIVE   AND  INNOVATIVE  GRANTS;  EXPRESSING  LEGISLATIVE  INTENT  THAT
21        $3,750,000 BE DISTRIBUTED FOR SUPPORT OF PROGRAMS FOR STUDENTS  WITH  NON-

30        THE IDAHO SAFE  AND  DRUG-FREE  SCHOOLS  PROGRAM;  EXPRESSING  LEGISLATIVE
31        INTENT REGARDING EXPENDITURE AND DISTRIBUTION OF $1,000,000 FOR EMPLOYMENT
32        AND  TRAINING FOR WORKING WITH CHILDREN WITH DISABILITIES; EXPRESSING LEG-
33        ISLATIVE INTENT THAT $500,000 BE DISTRIBUTED FOR  TRAINING  TO  SERVE  THE
34        NEEDS  OF  GIFTED  AND  TALENTED  STUDENTS AND PROVIDING FOR HOW THE FUNDS
35        SHALL BE ALLOCATED; APPROPRIATING THE AMOUNT OF GENERAL FUNDS NECESSARY AS
36        DETERMINED BY SECTION 33-1002D, IDAHO CODE, FOR PROPERTY TAX  REPLACEMENT;
37        EXPRESSING  LEGISLATIVE  INTENT  THAT  AN AMOUNT NOT TO EXCEED $200,000 BE
38        EXPENDED TO UPDATE THE 1993 PUBLIC SCHOOLS  FACILITIES  STUDY;  EXPRESSING
39        LEGISLATIVE  INTENT  THAT  AN AMOUNT NOT TO EXCEED $51,000 BE EXPENDED FOR
40        AWARDS MADE TO INSTRUCTIONAL STAFF FOR CERTIFICATION BY THE NATIONAL BOARD
41        FOR PROFESSIONAL TEACHING STANDARDS; RECOGNIZING ADDITIONAL  STATE  FINAN-
42        CIAL  SUPPORT BEYOND ESTABLISHED BUDGETS AND EXPRESSING LEGISLATIVE INTENT
43        FOR THE USE OF THESE FUNDS AS A ONE-TIME SUPPLEMENT TO DISCRETIONARY FUND-
44        ING NEEDS  IN  THE  DISTRICTS;  AND  EXPRESSING  LEGISLATIVE  INTENT  THAT
45        $3,916,000  BE  EXPENDED  TO IMPLEMENT IDAHO'S 1999 COMPREHENSIVE LITERACY
46        ACT.

 1    Be It Enacted by the Legislature of the State of Idaho:

 2        SECTION 1.  It is legislative intent that the following  amount  shall  be
 3    expended  from  state  sources for public schools for the period July 1, 1999,
 4    through June 30, 2000:

18        SECTION 2.  There is hereby appropriated from the General Fund for  public
19    schools,  the  following  amount to be transferred to the Public School Income
20    Fund for the period July 1, 1999, through June 30, 2000:

23        SECTION 3.  There is hereby appropriated from  the  Public  School  Income
24    Fund  to  be  expended for the Educational Support Program pursuant to law and
25    the provisions of this act, not to exceed $877,869,000 for the period July  1,
26    1999, through June 30, 2000.

27        SECTION  4.  There  is  hereby  appropriated from the Public School Income
28    Fund the amount  necessary  for  the  Unemployment  Insurance  Program  to  be
29    expended  according  to  Section  72-1349A, Idaho Code, for the period July 1,
30    1999, through June 30, 2000.

31        SECTION 5.  That Section 33-1004E, Idaho Code, be, and the same is  hereby
32    amended to read as follows:

33        33-1004E.  DISTRICT'S  SALARY-BASED  APPORTIONMENT. Each district shall be
34    entitled to a salary-based apportionment calculated as provided in  this  sec-
35    tion.
36        1.  To  determine  the apportionment for instructional staff, first deter-
37    mine the district average experience and education index by placing all eligi-
38    ble district certificated instructional employees on the statewide index  pro-
39    vided  in  section 33-1004A, Idaho Code. The resulting average is the district
40    index. Districts with an index above the state  average  index  shall  receive
41    their  actual  index  but  not  more  than  the state average plus .03 for the
42    1994-95 school year, and shall receive their actual index but  not  more  than
43    the  state  average plus .06 for the 1995-96 school year, and thereafter shall
44    receive their actual district index. The district  instructional  staff  index
45    shall  be  multiplied  by  the  instructional  base  salary  of  $20, 306
46     915 . The amount so determined shall be  multiplied  by  the
47    district  staff  allowance  for  instructional staff determined as provided in
48    section 33-1004 2., Idaho Code. The resulting amount is the  district's  
49    salarybased     salary-based  apportionment for instructional

 1    staff.
 2        2.  To determine the  apportionment  for  district  administrative  staff,
 3    first determine the district average experience and education index by placing
 4    all eligible certificated administrative employees on the statewide index pro-
 5    vided  in  section 33-1004A, Idaho Code. The resulting average is the district
 6    index. Districts with an index above the state  average  index  shall  receive
 7    their actual index but not more than the state average plus .03 for the school
 8    year 1994-95, and shall receive their actual index but not more than the state
 9    average  index  plus  .06  for  the  1995-96 school year, and thereafter shall
10    receive their actual district index. The district administrative  staff  index
11    shall  be  multiplied  by  the base salary of $ 29,708  30,599
12    . The amount so determined shall be multiplied  by  the  district  staff
13    allowance  for  administrative staff determined as provided in section 33-1004
14    3., Idaho Code. The resulting amount is the district's salary-based apportion-
15    ment for administrative staff.
16        3.  To determine the apportionment for classified staff,  multiply  $
17    15,759    16,232   by the district classified staff allowance
18    determined as provided in section 33-1004 4., Idaho Code. The amount so deter-
19    mined is the district's apportionment for classified staff.
20        4.  The district's salary-based apportionment shall  be  the  sum  of  the
21    apportionments  calculated in subsections 1., 2. and 3., of this section, plus
22    the benefit apportionment as provided in section 33-1004F, Idaho Code.

23        SECTION 6.  The Department of Education shall have the authority to  moni-
24    tor  and evaluate the use of funds appropriated to public school districts for
25    enhancement programs.

26        SECTION 7.  It is legislative intent that $500,000 of the moneys appropri-
27    ated in Section 3 of this act shall be distributed for locally developed  pro-
28    grams in grades K-6 which address improvements in reading skills for students.
29    The reading improvement shall be distributed pro rata based on each district's
30    prior year K-6 student enrollment compared to the total prior year K-6 student
31    enrollment statewide.

32        SECTION 8.  It is legislative intent that $10,400,000 of the moneys appro-
33    priated  in  Section  3 of this act shall be expended by the Superintendent of
34    Public  Instruction  as  follows:  $3,135,000  for  ongoing  expenditures  and
35    $7,000,000 for one-time expenditures for the Public  School  Technology  Grant
36    Program  upon  direction  of  the Idaho Council for Technology in Learning, in
37    accordance with Section 33-4806, Idaho Code; and $265,000 to be transferred to
38    the Library Services Improvement Fund for the State Library's "Libraries Link-
39    ing Idaho" (LiLI) statewide database licensing project. Of the $7,000,000 des-
40    ignated for one-time expenditures, $3,000,000 shall not be expended until  the
41    independent third party review required in Section 9 of this act has been com-
42    pleted and determined to be acceptable by the Governor.

43        SECTION 9.  It is legislative intent that an amount not to exceed $150,000
44    of  the  $10,400,000  referenced in Section 8 of this act shall be expended by
45    the Superintendent  of  Public  Instruction  for  staff  support  and  various
46    expenses  related  to the Idaho Council for Technology in Learning as approved
47    by the State Board of Education. Within the Council expenses, an amount not to
48    exceed $40,000 shall be used to conduct a qualitative evaluation on the effec-
49    tiveness of the Public School Technology Grant Program  in  improving  student
50    learning  and  achievement.  The evaluation shall include an independent third
51    party review as determined by the Governor with a report of the evaluation and

 1    review to be received by the Joint  Finance-Appropriations  Committee,  Senate
 2    Education  Committee,  and House Education Committee no later than December 1,
 3    1999.

 4        SECTION 10.  It is legislative intent that $425,000 of the  moneys  appro-
 5    priated  in Section 3 of this act be distributed by the Superintendent of Pub-
 6    lic Instruction as grants to teachers or groups of teachers for  the  develop-
 7    ment of creative and innovative instructional methods or curriculum.

 8        SECTION 11.  It is legislative intent that $3,750,000 of the moneys appro-
 9    priated  in  Section  3 of this act be distributed for support of programs for
10    students with non-English or  limited-English  proficiency.  The  funding  for
11    limited-English  proficiency  programs  shall be allocated to school districts
12    pro rata based upon the  population  of  limited-English  proficient  students
13    under criteria established by the State Department of Education.

14        SECTION  12.  It  is legislative intent that $375,000 of the moneys appro-
15    priated in Section 3 of this act shall be distributed by  the  State  Superin-
16    tendent  of  Public Instruction for a teacher-mentor program. Payment shall be
17    calculated on the number of first-year teachers and teachers  returning  after
18    an absence of five (5) years or more. Funds may be used to provide mentor sti-
19    pends, release time, and professional development opportunities.

20        SECTION  13.  It  is legislative intent that of the amount appropriated in
21    Section 3 of this act, an amount not to exceed  $5,175,000  as  determined  by
22    available  revenues  accruing pursuant to Sections 63-2506 and 63-2552A, Idaho
23    Code, and other such moneys which may become  available  pursuant  to  section
24    67-7439,  Idaho  Code,  shall  be  expended  by  the  Superintendent of Public
25    Instruction for the Idaho Safe and Drug-Free Schools Program  for  the  period
26    July 1, 1999, through June 30, 2000.

27        SECTION  14.  It  is  legislative intent that the funds for the Idaho Safe
28    and Drug-Free Schools Program referenced in Section 13 of this  act  shall  be
29    distributed as follows: $100,000 may be utilized by the Superintendent of Pub-
30    lic  Instruction  for program administration, technical assistance and evalua-
31    tion. Of the remaining amount, ninety-five percent (95%) shall be  distributed
32    to each school district through a combination of a base amount of $1,500 and a
33    prorated  amount  based  on  the prior year's average daily attendance. Of the
34    remaining five percent (5%), $80,000 shall be distributed on a one-time  basis
35    to  the  Commission  on Hispanic Affairs and used to encourage and direct His-
36    panic youth away from the habitual use of tobacco, alcohol, and other drugs by
37    developing programs for schools, families and communities, with the  remainder
38    used  to  make discretionary grants as determined by the Drug-Free Schools and
39    Communities Advisory Board.

40        SECTION 15.  It is legislative intent that the Idaho  Safe  and  Drug-Free
41    Schools Program shall include the following:
42        (1)  Districts  will  develop a policy and plan which will provide a guide
43    for their substance abuse program.
44        (2)  Districts will have an advisory board to assist each district in mak-
45    ing decisions relating to the program.
46        (3)  The districts' substance abuse programs will be comprehensive to meet
47    the needs of all students. This  will  include  prevention  programs,  student
48    assistance programs that address early identification and referral, and after-
49    care.

 1        (4)  Districts  shall  submit an annual evaluation of their program to the
 2    State Department of Education as to the effectiveness of their programs.

 3        SECTION 16.  It is legislative intent that $1,000,000 of the moneys appro-
 4    priated in Section 3 of this act shall be distributed for the following:
 5        (1)  Training of regular classroom teachers in working with children  with
 6    disabilities;
 7        (2)  Employing  and training aides to assist regular classroom teachers in
 8    working with children with disabilities;
 9        (3)  Employing substitute teachers whose employment allows regular  class-
10    room  teachers  to be involved in college planning, parent contact, Individual
11    Education Plan (IEP) development, curriculum modification, or other  necessary
12    activities directly related to meeting the needs of students in regular educa-
13    tion classrooms;
14        (4)  Moneys in this section shall be distributed pro rata to the districts
15    as  follows:  fifty  percent  (50%)  on the basis of the prior year's December
16    first child count and fifty percent (50%) on the basis  of  the  prior  year's
17    average daily attendance.
18        It  is  legislative  intent  that these funds be used to supplement rather
19    than supplant existing efforts in the training of regular  classroom  teachers
20    and  the  employment  and  training of aides; and that the State Department of
21    Education shall create a one-page report to be  provided  to  the  Legislature
22    showing  current  individual  district expenditures in this area, as well as a
23    breakdown of how these appropriated moneys were spent.
24        It is further legislative intent that these funds shall not be used in any
25    calculation or report to the federal government that obligates a future appro-
26    priation of this amount or any other amount.

27        SECTION 17.  It is legislative intent that $500,000 of the  moneys  appro-
28    priated  in  Section  3  of this act be distributed to train general education
29    teachers, gifted/talented (G/T) facilitators, administrators and/or parents to
30    better meet the needs of gifted/talented students.  One-half  (1/2)  of  these
31    funds  shall  be  allocated pro rata based on each district's prior year total
32    student enrollment compared to the prior year total statewide enrollment. One-
33    half (1/2)  of  these  funds  shall  be  allocated  based  on  the  number  of
34    gifted/talented  students  identified  and  served  as  indicated on the prior
35    year's December first child count.  The  number  of  gifted/talented  students
36    identified  for purposes of this section will not exceed seven percent (7%) of
37    the district's total student enrollment. No district will  receive  less  than
38    $300.  Funds  shall be distributed upon submission and approval of an applica-
39    tion submitted to the State Department of Education demonstrating how  in-ser-
40    vice  training  will  establish  or  improve  identification  and  service  of
41    gifted/talented students in the five (5) mandated talent areas.

42        SECTION  18.  There  is  hereby appropriated from the Public School Income
43    Fund the amount necessary for property tax replacement, to be expended accord-
44    ing to Section 33-1002D, Idaho Code, for the period July 1, 1999, through June
45    30, 2000.

46        SECTION 19.  It is legislative intent that up to $200,000  of  the  moneys
47    appropriated  in  Section  3  of  this  act  be used to update the 1993 Public
48    Schools Facilities Study.

49        SECTION 20.  It is legislative intent that up to  $51,000  of  the  moneys
50    appropriated  in Section 3 of this act be awarded to those instructional staff

 1    members who have successfully completed certification by  the  National  Board
 2    for  Professional Teaching Standards as of July 1 of each year. The staff mem-
 3    ber having obtained national certification shall be  designated  as  a  master
 4    teacher and receive a one-time award for this accomplishment if employed by an
 5    Idaho school district for that same academic year.

 6        SECTION  21.  Whereas the Legislature recognizes that due to the reduction
 7    of Public Employee Retirement System rates and the reduction of the  estimated
 8    support units used to establish budgets for Idaho's school districts, an addi-
 9    tional  and substantial amount of state discretionary funding per support unit
10    will become available. It is therefore the intent of the Legislature that this
11    additional state financial support, together with those amounts  estimated  in
12    the  regular fiscal year 2000 budget, be utilized by the school districts as a
13    one-time supplement to discretionary funding needs.

14        SECTION 22.  It is legislative intent that $3,916,000 of the moneys appro-
15    priated  in  Section  3  of  this  act  be  used  to  implement  Idaho's  1999
16    "Comprehensive Literacy Act: Every Child's Birthright" in the form and fashion
17    prescribed according to the associated legislation.
