                               BY APPROPRIATIONS COMMITTEE

 1                                        AN ACT
 2    RELATING TO INCOME TAXES ON LOTTERY WINNINGS; RESTATING AND EXPRESSING  LEGIS-
 3        LATIVE  INTENT  UNDER  EXISTING LAW IN RELATION TO INCOME TAXES ON LOTTERY
 4        WINNINGS; AND APPROPRIATING MONEYS FOR PUBLIC SCHOOL SUPPORT  TO  BE  USED
 5        FOR THE IDAHO SAFE AND DRUG-FREE SCHOOLS PROGRAM.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  It  is  legislative  intent that whereas Chapter 382, Laws of
 8    1997, provides that income taxes be imposed on lottery  prizes  received  from
 9    lottery  tickets over $600 as provided for in Section 67-7439, Idaho Code, and
10    that the intent of Chapter 382, Laws of 1997, was to provide a source of funds
11    for county juvenile probation services and for substance abuse programs in the
12    public schools, and that because such taxes accrue to the state  General  Fund
13    and  must  be appropriated to meet the intent of the act, the following appro-
14    priation is authorized.

15        SECTION 2.  There is hereby  appropriated  and  the  State  Controller  is
16    directed to transfer $200,000 from the General Fund for the Public School Edu-
17    cational  Support  Program  for deposit in the Public School Income Fund to be
18    used for the Idaho Safe and Drug-Free Schools Program for the period  July  1,
19    1999, through June 30, 2000.

This bill provides $200,000 as a revenue transfer from the General Fund
to the Public School Income Fund for the Idaho Safe and Drug-Free Schools
Program for Fiscal Year 2000 pursuant to the provisions Chapter 382, Laws
of 1997 which directs that income taxes on lottery prizes received from
lottery tickets over $600 be divided 50% for county juvenile probation
services and 50% for substance abuse programs in the public schools.
There was an additional $200,000 appropriated for county juvenile
probation services contained in House Bill 333 which is the FY 2000
appropriation bill for the Department of Juvenile Corrections.

                                  
                             FISCAL NOTE

$200,000 one-time cost to the State General Fund for FY 2000.
