The appropriation made in House Bill 374 of the First Regular 13 Session of the Fifty-fifth Idaho Legislature, is hereby reduced by the follow- 14 ing amounts in the designated program according to the designated expense 15 classes from the listed fund for the period July 1, 1999, through June 30, 16 2000: 17 REGULATED CARRIERS: 18 FOR: 19 Personnel Costs $251,100 20 Operating Expenditures 31,700 21 Capital Outlay 6,600 22 TOTAL $289,400 23 FROM: 24 Public Utilities Commission Fund $289,400 25 SECTION 2. The number of full-time equivalent positions authorized in 26 House Bill 374 of the First Regular Session of the Fifty-fifth Idaho Legisla- 27 ture is hereby reduced by six (6) positions for the period July 1, 1999, 28 through June 30, 2000, for the program specified in Section 1 of this act. 29 SECTION 3. In addition to any other appropriation made by the First Regu- 30 lar Session of the Fifty-fifth Idaho Legislature, there is hereby appropriated 31 to the Idaho Transportation Department the following amounts to be expended 32 for the designated program according to the designated expense classes from 33 the listed fund for the period July 1, 1999, through June 30, 2000: 34 MOTOR VEHICLES: 35 FOR: 36 Personnel Costs $ 68,100 37 Operating Expenditures 26,500 38 Capital Outlay 6,600 39 TOTAL $101,200 40 FROM: 41 State Highway Fund (Dedicated) $101,200 2 1 SECTION 4. In addition to any other positions authorized by the First 2 Regular Session of the Fifty-fifth Idaho Legislature, the Idaho Transportation 3 Department is authorized an additional four (4) full-time equivalent positions 4 for the period July 1, 1999, through June 30, 2000, for the program specified 5 in Section 3 of this act. 6 SECTION 5. In addition to any other appropriation made by the First Regu- 7 lar Session of the Fifty-fifth Idaho Legislature, there is hereby appropriated 8 to the Idaho Department of Law Enforcement the following amounts to be 9 expended for the designated program according to the designated expense clas- 10 ses from the listed fund for the period July 1, 1999, through June 30, 2000: 11 IDAHO STATE POLICE: 12 FOR: 13 Personnel Costs $192,800 14 Operating Expenditures 32,600 15 Capital Outlay 30,000 16 TOTAL $255,400 17 FROM: 18 Law Enforcement Fund $255,400 19 SECTION 6. In addition to any other positions authorized by the First 20 Regular Session of the Fifty-fifth Idaho Legislature, the Idaho Department of 21 Law Enforcement is authorized an additional four (4) full-time equivalent 22 positions for the period July 1, 1999, through June 30, 2000, for the program 23 specified in Section 5 of this act. 24 SECTION 7. No sooner than January 3, 2000, at the request of the Presi- 25 dent of the Public Utilities Commission, the State Controller shall make cash 26 transfers totaling $300,000 from the State Highway Fund, from revenues gener- 27 ated by Section 49-202(2)(o), Idaho Code, as amended by House Bill 335 aaS, 28 aaS, enacted by the First Regular Session of the Fifty-fifth Idaho Legisla- 29 ture, to the Public Utilities Commission Fund for the period July 1, 1999, 30 through June 30, 2000.

STATEMENT OF PURPOSE RS 09212C1 This is a trailer appropriation bill for HB 335. HB 335 removes the Idaho Public Utilities Commission (IPUC) from regulation of the motor carrier (trucking) industry and places the administration of insurance verification and safety inspection with the Idaho Transportation Department (ITD). The transportation department will integrate the insurance program and compliance reviews into the one-stop shop for the motor carrier industry and contract safety inspections with the Department of Law Enforcement (DLE). FISCAL NOTE There is no impact on the General Eund. All funding is from a $2 fee charged to motor carriers. This bill reduces the PUC appropriation contained in HB 374 by $289,400 and 6 full-time equivalent positions. It increases the ITD appropriation by $356,600 and 4 FTP's. It also increases the DLE appropriation by $167,200 and 2 positions, including one sergeant and one corporal. Annual revenues from a $2 per truck fee are estimated at $656,600. A one-time transfer of $300,000 to the PUC to cover their revenue shortfall leaves estimated revenues of $356,600. A first-year contract of $167,200 with DLE leaves ITD with $189,400 for two insurance compliance specialists and two Port-of-Entry inspectors. In the future, as funding and vacancies permit, two of ITD's positions will be eliminated and transferred to DLE. ITD will expand the contract for safety inspections and compliance reviews with DLE.
