Within the appropriation provided in Section 1 of this act, 17 the State Controller shall make transfers from the General Fund, the Water 18 Pollution Control Fund, and the Air Quality Permitting Fund to the Cooperative 19 Welfare Fund - DEQ, periodically, as requested by the Administrator of the 20 Division of Environmental Quality and approved by the Board of Examiners. 21 SECTION 3. There is hereby reappropriated to the Department of Health and 22 Welfare for the Division of Environmental Quality any unexpended and unencum- 23 bered balances of the Cooperative Welfare Fund - DEQ as appropriated for the 24 Division of Environmental Quality for fiscal year 1999, to be used for non- 25 recurring expenditures only for the period July 1, 1999, through June 30, 26 2000. The Department of Health and Welfare shall adjust the amount of reappro- 27 priation so as not to exceed available moneys. 28 SECTION 4. In accordance with Section 67-3519, Idaho Code, the Department 29 of Health and Welfare is authorized no more than three hundred fifty-seven and 30 fifty-five hundredths (357.55) full-time equivalent positions in the Division 31 of Environmental Quality at any point during the period July 1, 1999, through 32 June 30, 2000, unless specifically authorized by the Governor. The Joint 33 Finance-Appropriations Committee will be notified promptly of any increased 34 positions so authorized. 35 SECTION 5. It is legislative intent that the appropriation of moneys from 36 the Water Pollution Control Fund specifically supersedes the provisions of 37 Section 39-3630, Idaho Code. 38 SECTION 6. In addition to the appropriation contained in Section 1 of 39 this act, the State Controller is hereby directed to transfer $520,000 from 40 the Water Pollution Control Fund to the Environmental Remediation Fund for the 41 period July 1, 1999, through June 30, 2000. 42 SECTION 7. It is legislative intent that moneys deposited into the Envi- 43 ronmental Remediation Fund are to be used solely for Bunker Hill remediation 44 within the site and that in accordance with the Bunker Hill Remedial Action 45 Management Plan, an annual report shall be filed no later than January 1 of 46 each year with the Governor, the Legislature, and the Bunker Hill Superfund 47 Task Force on the remediation progress and the expenditures involved. 4 1 SECTION 8. Notwithstanding the provisions of Section 39-4417, Idaho Code, 2 the State Controller is hereby directed to transfer $350,000 from the Hazard- 3 ous Waste Emergency Fund to the General Fund for the period July 1, 1999, 4 through June 30, 2000. 5 SECTION 9. To provide maximum flexibility, the Division of Environmental 6 Quality is hereby exempted from the provisions of Section 67-3511(2), Idaho 7 Code, for all moneys appropriated to it for the period July 1, 1999, through 8 June 30, 2000. Transfers of moneys between the programs in this act are still 9 subject to the approval of the Division of Financial Management and the Board 10 of Examiners. 11 SECTION 10. The State Controller is hereby directed to transfer 12 $1,500,000 from the Water Pollution Control Fund to the Resource Conservation 13 and Rangeland Development Fund for the period July 1, 1999, through June 30, 14 2000. 15 SECTION 11. In addition to the appropriation made in Section 1, Senate 16 Bill 1268, enacted by the First Regular Session of the Fifty-fifth Idaho Leg- 17 islature, there is hereby appropriated to the Soil Conservation Commission in 18 the Department of Agriculture, the following amount to be expended according 19 to the designated expense class from the listed fund for the period July 1, 20 1999, through June 30, 2000: 21 FOR: 22 Trustee and Benefit Payments $500,000 23 FROM: 24 Resource Conservation and Rangeland Development Fund $500,000
