HCR016|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 16 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO 3 APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF THE APPROPRIATE 4 USE OF THE FUNDS WHICH WILL ACCRUE TO IDAHO BASED UPON THE TOBACCO SETTLE- 5 MENT. 6 Be It Resolved by the Legislature of the State of Idaho: 7 WHEREAS, on November 23, 1998, the Attorneys General and other representa- 8 tives of Idaho and 45 other states, Puerto Rico, the U.S. Virgin Islands, the 9 Northern Mariana Islands, Guam and the District of Columbia signed an agree- 10 ment with the five largest tobacco manufacturers, (Brown & Williamson Tobacco 11 Corporation, Lorillard Tobacco Company, Philip Morris Incorporated, R.J. 12 Reynolds Tobacco Company, and Liggett & Myers); and 13 WHEREAS, the Legislature concurs that the agreement will advance the gen- 14 eral welfare by taking significant action to reduce the promotion of smoking 15 among the youth with actions which include prohibiting advertising targeted at 16 youth, prohibiting marketing and promotions employing cartoon characters, 17 restricting brand name sponsorships of events with youth audiences, and 18 banning youth access to free samples; and 19 WHEREAS, the agreement includes a financial settlement of $206 billion 20 over the next 25 years, of which Idaho's share is estimated at $711.7 million 21 with annual payments beginning at $23.3 million in FY 2000; and 22 WHEREAS, several aspects of the agreement are not finalized including 23 attainment of the State Specific Finality by December 31, 2001, and similar 24 State Specific Finality by a sufficient number of the participating states to 25 achieve implementation; and 26 WHEREAS, procedures for disbursing these funds are left to the individual 27 states; and 28 WHEREAS, many Idaho interests have advanced legitimate claims upon a por- 29 tion of this funding based upon costs incurred in the past, services to be 30 provided in the future, and other reasonable contentions. 31 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 32 of the Fifty-fifth Idaho Legislature, the House of Representatives and the 33 Senate concurring therein, that the Legislative Council is authorized to 34 appoint a committee to undertake and complete a study of the appropriate use 35 of the funds which will accrue to Idaho based upon the tobacco settlement. The 36 Legislative Council shall determine the number of legislators and membership 37 for each house appointed to the committee and shall authorize the committee to 38 receive input, advice and assistance from interested and affected parties who 39 are not members of the legislature. The committee should conduct a reasonable 40 number of public hearings in order to facilitate input from throughout the 41 state. 42 BE IT FURTHER RESOLVED that nonlegislative members of the committee may be 43 appointed by the cochairs of the committee who are appointed by the Legisla- 44 tive Council. Nonlegislative members of the advisory committee shall not be 1 reimbursed from legislative funds for per diem, mileage or other expenses and 2 shall not have voting privileges regarding the committee's recommendations or 3 proposed legislation. 4 BE IT FURTHER RESOLVED that the committee shall report its findings, rec- 5 ommendations and proposed legislation, if any, to the Second Regular Session 6 of the Fifty-fifth Idaho Legislature.
STATEMENT OF PURPOSE RS09001 The purpose of this concurrent resolution is to authorize Legislative Council to appoint an interim committee to study the appropriate use of tobacco settlement funds and to hold public hearings.
