HJM004|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT MEMORIAL NO. 4 BY EDUCATION COMMITTEE 1 A JOINT MEMORIAL 2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS 3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF 4 IDAHO IN THE CONGRESS OF THE UNITED STATES. 5 We, your Memorialists, the House of Representatives and the Senate of the 6 State of Idaho assembled in the First Regular Session of the Fifty-fifth Idaho 7 Legislature, do hereby respectfully represent that: 8 WHEREAS, under the provisions of the Forest Service law of May 23, 1908, 9 35 Stat. 259, 260, 267 and as subsequently amended by the National Forest Man- 10 agement Act and the Federal Land Policy Management Act, the United States For- 11 est Service pays to counties through the state treasurer twenty-five percent 12 of gross revenues from timber sales, grazing permits and leases, recreation 13 fees, power line rights-of-way, special use permits and other programs; and 14 WHEREAS, the payments are made to states from each national forest, then 15 are apportioned to counties according to the proportion of acreage of each 16 national forest in each county; and 17 WHEREAS, the law mandates that these funds be used for public roads and 18 public schools; and 19 WHEREAS, counties have few sources of revenue and rely on these payments 20 to maintain their public roads and their public schools; and 21 WHEREAS, the Forest Service payments have become unpredictable due to mar- 22 ket fluctuations and the volatility of the public debate on timber harvests on 23 national forests, and generally have declined because of reduced timber har- 24 vest on national forests; and 25 WHEREAS, demands on counties to provide good public roads and public 26 schools have increased due to increases in resident population and tourism; 27 and 28 WHEREAS, stabilizing payments required by the 1908 Forest Service law is 29 essential for responsible fiscal planning by the counties. 30 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 31 of the Fifty-fifth Idaho Legislature, the House of Representatives and the 32 Senate concurring therein, that we strongly support stabilization of payments 33 of the United States Forest Service to county governments through the state 34 treasurer and urge our congressional delegation representing the state of 35 Idaho in the Congress of the United States to support legislation that will 36 stabilize payments made by the United States Forest Service to the counties of 37 the state of Idaho. 38 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa- 39 tives be, and she is hereby authorized and directed to forward a copy of this 40 Memorial to the President of the Senate and the Speaker of the House of Repre- 41 sentatives of Congress, and the congressional delegation representing the 42 state of Idaho in the Congress of the United States.
STATEMENT OF PURPOSE RS 09068 The purpose of this Joint Memorial is to urge Congress and the Idaho Congressional Delegation to pass legislation modifying requirements for paying Federal timber sale receipts in order to stabilize Forest Service Payments to counties.
