                             BY HEALTH AND WELFARE COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE BOARD OF PSYCHOLOGIST  EXAMINERS;  AMENDING  SECTION  54-2304,
 3        IDAHO  CODE,  TO INCREASE THE SIZE OF THE BOARD AND INCREASE THE LENGTH OF
 4        TERM OF BOARD MEMBERS; REPEALING SECTION 54-2308, IDAHO CODE; AND AMENDING
 5        SECTION 54-2315, IDAHO CODE, TO AUTHORIZE  AN  INCREASE  IN  THE  FEE  FOR
 6        LICENSE RENEWAL.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION  1.  That  Section 54-2304, Idaho Code, be, and the same is hereby
 9    amended to read as follows:

10        54-2304.  ESTABLISHMENT OF  BOARD  OF  PSYCHOLOGIST  EXAMINERS.  There  is
11    hereby  created  in  the department of self-governing agencies, an Idaho state
12    board of psychologist examiners as follows:
13        (a)  Said board shall consist of   three      four  
14    (  3  4 ) licensed psychologist members and one (1) pub-
15    lic member who is not a practitioner or spouse of a practitioner in any health
16    care field and who is not a convicted felon and who has not been an  applicant
17    for  licensure as a psychologist, who are citizens of the United States, resi-
18    dents of the state of Idaho, and appointed by the  governor  for    three
19       four  ( 3  4 ) year terms.  The psy-
20    chologist members' terms shall be  staggered  such  that  only  one  (1)  term
21    expires June 30 of each year.
22        (b)  Each psychologist board member shall be licensed under this act.
23        (c)  When the term of each psychologist member of the board ends, the gov-
24    ernor  shall appoint his successor for a term of  three   four
25     ( 3  4 ) years from a list of eligible candidates
26    for board membership submitted to the governor by the president of  the  Idaho
27    psychological  association. Any vacancy occurring on the board shall be filled
28    by the governor, from a list of all eligible candidates for board  membership,
29    by  appointment for the unexpired term. The governor may give consideration to
30    recommendations from any source in making appointments of the public member to
31    a full or unexpired term. The governor may remove any board member for miscon-
32    duct, incompetency, or neglect of duty after giving the board member a written
33    statement of the charges and an opportunity to be heard thereon.
34        (d)  At all times, the board shall have at least one  (1)  member  who  is
35    engaged  primarily  in  rendering  services in psychology and at least one (1)
36    member who is engaged primarily in teaching, training, or research in psychol-
37    ogy.
38        (e)  No board member shall serve more than two (2) consecutive terms.
39        (f)  Each board  member  shall  be  compensated  as  provided  by  section
40    59-509(n), Idaho Code.
41        (g)  The  board  shall  annually in the month of July, hold a meeting, and
42    elect a chairman and vice chairman. The board shall meet at such  other  times
43    as  deemed  necessary  and  advisable by the chairman, or by a majority of its

 1    members, or by the governor. Reasonable notice of all meetings shall be  given
 2    in  the  manner prescribed by the board. A majority of the board shall consti-
 3    tute a quorum at any meeting or hearing.

 4        SECTION 2.  That Section 54-2308, Idaho Code, be, and the same  is  hereby
 5    repealed.

 6        SECTION  3.  That  Section 54-2315, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        54-2315.  ADMINISTRATION BY BUREAU OF OCCUPATIONAL  LICENSES  --  FEE  FOR
 9    RENEWAL  OF  LICENSE.  This act shall be administered by the bureau of occupa-
10    tional licenses. The fee for renewal of license shall be a fee as  established
11    by  board  rule  not  to  exceed  two hundred  twenty-five  dollars
12    ($2 00  25 ) per annum.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE
                             RS08348


 Amend existing statute to increase the annual renewal fee not
to exceed $225.00; delete and reserve Section 54-2303, Idaho
Code; and add an additional licensed psychologist board member
and increase the terms to four (4) years.

FISCAL IMPACT
There is no fiscal impact to the General Fund.
It is necessary to increase the annual renewal fee by $25.00
in order to implement the Patient Freedom of Information Act
that will be effective January, 2000.
Anticipated revenue from the $25.00 increase:
213 licensed psychologists X $25.00 = $5,325.00
