S1038|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1038 BY SCHROEDER 1 AN ACT 2 RELATING TO PUBLIC SCHOOL SAFETY; AMENDING CHAPTER 9, TITLE 33, IDAHO CODE, BY 3 THE ADDITION OF A NEW SECTION 33-906, IDAHO CODE, TO CREATE THE IDAHO PUB- 4 LIC SCHOOL SAFETY COMMISSION AND TO SPECIFY MEMBERSHIP; AMENDING CHAPTER 5 9, TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-907, IDAHO 6 CODE, TO AUTHORIZE AWARDS OF GRANTS BASED UPON CRITERIA DEVELOPED BY THE 7 COMMISSION; AMENDING CHAPTER 9, TITLE 33, IDAHO CODE, BY THE ADDITION OF A 8 NEW SECTION 33-908, IDAHO CODE, TO REQUIRE REPORTS; APPROPRIATING MONEYS 9 TO THE STATE BOARD OF EDUCATION FOR THE PURPOSES OF THE IDAHO PUBLIC 10 SCHOOL SAFETY COMMISSION; AND PROVIDING A SUNSET DATE. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. That Chapter 9, Title 33, Idaho Code, be, and the same is 13 hereby amended by the addition thereto of a NEW SECTION , to be 14 known and designated as Section 33-906, Idaho Code, and to read as follows: 15 33-906. IDAHO PUBLIC SCHOOL SAFETY COMMISSION. There is hereby created in 16 the office of the state board of education the Idaho public school safety com- 17 mission. The commission shall be composed of five (5) members appointed by the 18 governor. Not more than three (3) shall be members of the same political 19 party. The members shall be drawn from throughout the state and be as 20 geographically representative of the state as possible. Members shall serve a 21 term of five (5) years, except that of the members first appointed one (1) 22 shall serve a term of one (1) year, one (1) shall serve a term of two (2) 23 years, one (1) shall serve a term of three (3) years, one (1) shall serve a 24 term of four (4) years, and one (1) shall serve a term of five (5) years. Mem- 25 bers shall be reimbursed expenses as provided in section 59-509(b), Idaho 26 Code. The commission shall meet and organize itself upon the call of the gov- 27 ernor, and thereafter upon the call of the chairman. 28 SECTION 2. That Chapter 9, Title 33, Idaho Code, be, and the same is 29 hereby amended by the addition thereto of a NEW SECTION , to be 30 known and designated as Section 33-907, Idaho Code, and to read as follows: 31 33-907. SAFETY GRANTS. (1) The commission shall advise the state board 32 of education in matters related to the safety of public school facilities, and 33 shall administer the funds appropriated to it for the purpose of public school 34 safety grants. 35 The commission shall establish criteria for the distribution of safety 36 grants. The criteria shall address the severity of the safety concern, the 37 number of times patrons of the district have attempted to bond for purposes of 38 addressing the safety concern, the existence of any nonessential activities or 39 services in the school district, the existing bonded indebtedness of the dis- 40 trict, and other issues as deemed appropriate by the commission. 41 The commission shall recommend to the state board the terms of grants, 2 1 including whether and when matching funds are required by the district, and 2 whether and when a project will be funded in whole or in part. The board of 3 education shall establish the terms of grants made from the funds appropriated 4 to it. 5 (2) All payments from appropriations to the commission shall be paid out 6 directly to the school district in warrants drawn by the state controller upon 7 presentation of proper vouchers from the state board of education. Pending 8 payments from the funds, they shall be invested by the state treasurer in the 9 same manner as provided under section 67-1210, Idaho Code, with respect to 10 other idle moneys in the state treasury. Interest earned on the investments 11 shall be returned to the account of the commission. 12 SECTION 3. That Chapter 9, Title 33, Idaho Code, be, and the same is 13 hereby amended by the addition thereto of a NEW SECTION , to be 14 known and designated as Section 33-908, Idaho Code, and to read as follows: 15 33-908. REPORTS. (1) Each school district which is a recipient of moneys 16 from the school safety commission shall account to the commission for the 17 funds in such detail as the commission requires on forms provided by the com- 18 mission. 19 (2) The commission shall report annually to the legislature on programs 20 administered by the commission. 21 SECTION 4. In addition to other appropriations, there is hereby appropri- 22 ated to the State Board of Education for administration as public school 23 safety grants by the Idaho Public School Safety Commission, $1,000,000. It is 24 the intent of the Legislature that not less than an additional $1,000,000 25 shall be appropriated annually for the continuation of the work of the commis- 26 sion. 27 SECTION 5. The provisions of Sections 1, 2 and 3 of this act shall be 28 null, void and of no force and effect on and after June 30, 2004.
STATEMENT OF PURPOSE RS08755 The purpose of this legislation is to create the Idaho PUblic School Safety Commission and to specify membership, to authorize grants based Upon criteria developed by the Commission, to require reports, to appropriate moneys to the State Board of Education for the purposes of the Idaho Public School Safety Commission and to provide a sunset date.
