IDENTIFICATION CARDS - Amends existing law to provide for the issuance of a
no-fee identification card when a driver voluntarily surrenders his
driver's license, when the driver's license has been cancelled for reasons
of impairment, incompetence or inability of the driver to safely operate a

 1                                        AN ACT
 2    RELATING TO DRIVER'S  LICENSES  AND  IDENTIFICATION  CARDS;  AMENDING  SECTION
 3        49-322,  IDAHO  CODE, TO PROVIDE THAT WHEN A DRIVER'S LICENSE IS CANCELLED
 4        FOR REASONS OF IMPAIRMENT, INCOMPETENCE OR INABILITY OF  THE  LICENSEE  TO
 5        SAFELY OPERATE A MOTOR VEHICLE AND THE LICENSE IS VOLUNTARILY SURRENDERED,
 6        THE  LICENSEE MAY BE ELIGIBLE FOR A NO-FEE IDENTIFICATION CARD; AND AMEND-
 7        ING SECTION 49-2444, IDAHO CODE, TO PROVIDE FOR ISSUANCE OF A NO-FEE IDEN-
 8        TIFICATION CARD.

 9    Be It Enacted by the Legislature of the State of Idaho:

10        SECTION 1.  That Section 49-322, Idaho Code, be, and the  same  is  hereby
11    amended to read as follows:

12        49-322.  AUTHORITY  OF  DEPARTMENT  TO  CANCEL  DRIVER'S  LICENSE. (1) The
13    department shall cancel any driver's license upon determining that the  licen-
14    see  was  not  entitled  to  the issuance of the driver's license, or that the
15    licensee failed to give the required or correct information  in  his  applica-
16    tion, or committed fraud in making the application.
17        (2)  Upon  a  cancellation,  the  licensee  shall  surrender the cancelled
18    driver's license to the department.
19        (3)  The department shall cancel a person's  commercial  driver's  license
20    upon determining that the class A, B, or C licensee has falsified information.
21    Upon  cancellation  of a class A, B, or C driver's license, the licensee shall
22    be disqualified from operating a commercial motor  vehicle  for  a  period  of
23    sixty (60) days.
24          (4)  When  a  driver's  license  has  been cancelled for reasons of
25    impairment, incompetence or inability of the  licensed  driver  to  operate  a
26    motor  vehicle safely as provided in section 49-303 or 49-326, Idaho Code, and
27    the licensee has voluntarily surrendered  his  driver's  license,  or  when  a
28    licensed  driver requests cancellation of his license for any of the same rea-
29    sons stated in this subsection and he voluntarily surrenders his license,  the
30    licensee  may be eligible for a no-fee identification card as provided in sec-
31    tion 49-2444, Idaho Code. 

32        SECTION 2.  That Section 49-2444, Idaho Code, be, and the same  is  hereby
33    amended to read as follows:

34        49-2444.  IDENTIFICATION  CARD  ISSUED.  (1) The department shall issue an
35    identification card which shall set forth the  information  contained  in  the
36    application,  in  a  form  as prescribed by the department. All identification
37    cards issued on or after January 1, 1993, shall not  contain  the  applicant's
38    social  security number. An applicant's social security number shall be exempt
39    from disclosure except for inquiries from agencies or institutions  authorized
40    to  obtain  such information by federal law or regulation, from peace officers
41    or from jury commissioners. Each card shall be issued a distinguishing  number

 1    and  shall  bear  upon  it  a color photograph of the applicant which shall be
 2    taken by the examiner at the time of  application.  The  photograph  shall  be
 3    taken without headgear or other clothing or device that disguises or otherwise
 4    conceals  the  face  or  head of the applicant. A waiver may be granted by the
 5    department allowing the applicant to wear headgear or other head covering  for
 6    medical,  religious or safety purposes so long as the face is not disguised or
 7    otherwise concealed. No person shall receive an identification card unless and
 8    until he surrenders to the department all identification cards in his  posses-
 9    sion    issued to him by Idaho or any other jurisdiction, or until he executes
10    an affidavit that he does not possess an identification card.  A  notation  of
11    "under  21  until (month, day, year)" and any other distinguishing printing of
12    the words "under 21" on the identification card shall be made  if  applicable.
13    The  nonrefundable  fee  for an identification card shall be seven dollars and
14    fifty cents ($7.50) of which five dollars ($5.00) shall  be  retained  by  the
15    county  and  credited  to  the current expense fund, and two dollars and fifty
16    cents ($2.50) shall be deposited in the state treasury to the  credit  of  the
17    highway  distribution  account.  Every identification card shall expire on the
18    cardholder's birthday in the fourth year following issuance of the card.
19        (2)  Every identification card shall be renewable on or before its expira-
20    tion, but not more than twelve (12) months before, and  upon  application  and
21    payment of the required fee.
22        (3)  When  an  identification  card  has been expired for less than twelve
23    (12) months, the renewal of the identification card shall start from the orig-
24    inal date of expiration regardless of the year in which  the  application  for
25    renewal  is  made.  If the identification card is expired for more than twelve
26    (12) months, the application shall expire on the applicant's birthday  in  the
27    fourth year following issuance of the identification card.
28        (4)  A  person possessing an identification card desiring to donate any or
29    all organs or tissue in the event of death, pursuant  to  the  provisions  for
30    donation of anatomical gifts as set forth in chapter 34, title 39, Idaho Code,
31    at the option of the donor may indicate this desire on the identification card
32    by the imprinting of the word "donor" on the identification card.
33        (5)  In the case of a name change, the applicant shall provide legal docu-
34    mentation to verify the change in accordance with department rules.
35        (6)  Whenever  any  person, after applying for or receiving an identifica-
36    tion card, shall move from the address shown on  the  application  or  on  the
37    identification  card  issued,  that  person  shall, within fourteen (14) days,
38    notify the transportation department in writing of the old and new addresses.
39        (7)  The department shall cancel any identification card upon  determining
40    that  the  person was not entitled to the issuance of the identification card,
41    or that the person failed to give the required and correct information in  his
42    application  or  committed fraud in making the application. Upon cancellation,
43    the person shall surrender the cancelled identification card  to  the  depart-
44    ment.
45        (8)  If  any person shall fail to return to the department the identifica-
46    tion card as required, the department may direct any peace officer  to  secure
47    its possession and return the identification card to the department.
48          (9)  The  department  may  issue a no-fee identification card to an
49    individual whose driver's license has been cancelled and  voluntarily  surren-
50    dered  as  provided  in section 49-322(4), Idaho Code. The identification card
51    may be renewed at no cost to the applicant as long  as  the  driver's  license
52    remains cancelled.

                           STATE MENT OF PURPOSE

This legislation amends Sections 49-322 and 49-2444, Idaho Code, to
provide for the issuance of an Identification Card, at no cost to
the applicant, in exchange for cancellation of the Idaho driver's
license for those individuals who are incompetent to drive for any
reason provided in section 49-303 and 49-326, Idaho Code (lapses in
consciousness, physical or mental disability preventing him from
reasonable control over a motor vehicle, inability to understand
highway signs, lack of adequate visual acuity). This waiver would be
an incentive for individuals to voluntarily surrender their driver's
license to the department because they would be able to acquire a
no-fee identification card for cashing checks, boarding airplanes,
etc. This amendment would promote customer service and enhance the
safety of all users sharing the highways and streets. The applicant
may renew the Identification Card at no cost as long as the driver's
license remains canceled for this purpose.

                              FISCAL IMPACT

Loss of revenue based on 100 waivers annually @ $7.50:
ITD $250 ($2.50 highway distribution account) 
County Sheriffs office statewide $500 ($5.00 current expense
account)

Fiscal impact on public: removing impaired or incompetent drivers
will save the public the costs associated with vehicle accident
damages.
