                                   SENATE BILL NO. 1095

 1                                        AN ACT
 2    RELATING TO AIR QUALITY PROGRAMS; AMENDING CHAPTER 4, TITLE 49, IDAHO CODE, BY
 3        THE ADDITION OF A NEW SECTION 49-454, IDAHO CODE, TO PROVIDE  FOR  COLLEC-
 4        TION  OF  FEES  FOR  AIR QUALITY TESTING OF MOTOR VEHICLE EMISSIONS AND TO
 5        PROVIDE PENALTIES.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION 1.  That Chapter 4, Title 49, Idaho Code,  be,  and  the  same  is
 8    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
 9    known and designated as Section 49-454, Idaho Code, and to read as follows:

10        49-454.  AIR QUALITY TESTING FEE. A city or county  which  administers  an
11    air  quality program established by ordinance for the inspection and readjust-
12    ment of motor vehicles as  part  of  an  approved  state  implementation  plan
13    adopted  by  the state and submitted to the federal government under 42 U.S.C.
14    Sec. 7410, may contract with the department for the  collection,  distribution
15    and  administration of the fee for such program in a like manner and under the
16    definitions and rules for the collection and administration of other registra-
17    tion fees as set forth in chapter 4, title 49, Idaho Code. Such fee shall  not
18    exceed  the  actual cost budgeted by the city or county for the administration
19    of the program and in no case shall exceed twelve dollars ($12.00) per vehicle
20    per annum. Each month, following receipt by the department  of  revenues  from
21    the  motor vehicle inspection and readjustment fee, the department shall remit
22    the same to the city or county implementing such fee, less  a  deduction  from
23    such  amount  for the department's actual costs for collection and administra-
24    tion of the fee, but not to exceed one and one-half  percent  (1  1/2%).  Fees
25    collected  under this section shall be separately identified and accounted for
26    and paid monthly to the city or county and shall not become part of the  state
27    highway account or the state highway distribution account.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE
                             RS 08706

This bill would allow the collection of a fee for administration of an air quality
program (in counties which operate such programs - currently only Ada County) at the time
of registration of a vehicle rather than upon vehicle inspection. This bill would allow for the
modernization of the air quality program to permit vehicle inspections by remote sensing
devices which would eliminate the inconvenience to many motorists of annual vehicle
inspections.

                          FISCAL IMPACT

No fiscal impact to the general fund. The bill would not increase fees to vehicle
owners. The bill would capture approximately $10,000.00 per year in unpaid air quality
program fees.
