                                   SENATE BILL NO. 1102

                             BY HEALTH AND WELFARE COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE BOARD OF NURSING; AMENDING SECTION  54-1403,  IDAHO  CODE,  TO
 3        INCREASE THE LENGTH OF A TERM OF APPOINTMENT TO THE BOARD, TO INCREASE THE
 4        NUMBER OF CONSECUTIVE TERMS THAT CAN BE SERVED AND TO INCREASE THE COMPEN-
 5        SATION  FOR  MEMBERS  OF  THE BOARD AND TO MAKE TECHNICAL CORRECTIONS; AND
 6        DECLARING AN EMERGENCY.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION 1.  That Section 54-1403, Idaho Code, be, and the same  is  hereby
 9    amended to read as follows:

10        54-1403.  BOARD  OF  NURSING. (1) Appointment, Removal and Term of Office.
11    There is hereby created within the department of self-governing  agencies  the
12    board of nursing for the state of Idaho composed of nine (9) members appointed
13    by the governor. Membership of the board shall consist of the following:
14        (a)   f  F ive (5) persons licensed to practice pro-
15        fessional  nursing  in  Idaho,  of whom three (3) shall be educated at the
16        associate degree level provided that one (1) of these  may  be  a  diploma
17        nurse,  and  two  (2)  of  whom  shall  be  educated at the baccalaureate,
18        master's or doctoral level;
19        (b)   t  T wo (2) persons licensed to practice prac-
20        tical nursing in Idaho;
21        (c)   o  O ne (1) person  licensed  as  an  advanced
22        practice nurse; and
23        (d)    o    O  ne  (1) person who is a lay person to
24        health care occupations.
25    In making appointments to the board,  consideration  shall  be  given  to  the
26    board's  responsibility  in  areas  of  education and practice. Members of the
27    board of nursing and of the advisory council  for  licensed  practical  nurses
28    holding  office  under prior law on the effective date of this act shall serve
29    as members of the board created herein until expiration  of  their  respective
30    terms  and, as those terms expire or become vacant, the governor shall appoint
31    such other persons as will constitute a complete board as  herein  prescribed.
32    The  two  (2)  members  appointed to reach the full membership provided herein
33    shall be persons licensed to practice professional  nursing  educated  at  the
34    associate  degree  level.  Persons  may be reappointed to the board so long as
35    they meet the qualifications of the position to  which  they  were  originally
36    appointed.  In  the  event  that a member has attained an additional degree of
37    education, they may not be reappointed to represent the board position  desig-
38    nated for another specific degree of education. Upon expiration of any term or
39    creation of any vacancy, the board shall notify the governor thereof, who then
40    shall  make  such  appointment  or  fill  such vacancy within sixty (60) days.
41    Appointments shall be for terms of  three   four  (
42    3  4 ) years except appointments to vacancies which shall  be
43    for  the  unexpired  term  being filled. No member shall be appointed for more

 1    than  two   three     (  2    3  )
 2      consecutive    terms. The governor may remove any member from the
 3    board for neglect of any duty required by law or for incompetency or unprofes-
 4    sional or dishonorable conduct.
 5        (2)  Qualifications of  m  M embers.  No  person  is
 6    qualified  for  appointment  hereunder  unless that person is a citizen of the
 7    United States and a resident of the state of Idaho.  Members  required  to  be
 8    licensed  hereunder shall not be qualified for appointment to the board unless
 9    actively engaged in some field of nursing in Idaho at the time of appointment.
10    No person is qualified for appointment as the lay member of the board  if  the
11    person  or  his  spouse  is licensed in any health occupation; is an employee,
12    officer or agent of or has any financial interest in any health care facility,
13    institution, or association or any insurance company authorized to  underwrite
14    health  care  insurance; or is engaged in the governance and administration of
15    any health care facility, institution or association.
16        (3)  Conduct of  b  B usiness. The board shall  meet
17    at such times as required to conduct the business of the board and shall annu-
18    ally  elect from its members a chairman, vice chairman and such other officers
19    as may be desirable. Five (5) members shall constitute a quorum and  the  vote
20    of  a  majority  of  members  present at a meeting wherein a quorum is present
21    shall determine the action of the board. Each member of  the  board  shall  be
22    compensated as provided by section 59-509( g  h ), Idaho
23    Code.

24        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
25    declared to exist, this act shall be in full force and effect on and after its
26    passage and approval.

                         STATEMENT OF PURPOSE

This legislation amends the existing law to increase the per diem
paid to Board members from $35. per day to $50. per day, which is in
addition to reimbursement for expenses related to travel, lodging
and meals. Further, the legislation increases the term of
appointment of Board of Nursing members from 3 years to 4 years with
the opportunity for appointment to three rather than the current two
consecutive terms.





                              FISCAL NOTE

No impact on the General Fund. No cost to the general public nor
increased cost to licensees. The increase of approximately $1700.00
per year will come from Board of Nursing dedicated funds, and,
because of the Board's available fund balance, will not require a
fee increase to licensees.
