S1152|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1152 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO LICENSES TO HUNT, TRAP AND FISH; AMENDING SECTION 36-401, IDAHO 3 CODE, TO PROVIDE THAT NO LICENSE TO HUNT, TRAP OR FISH SHALL BE REQUIRED 4 FOR DISABLED WAR VETERANS WHO HAVE RESIDED IN THE STATE FOR AT LEAST ONE 5 YEAR AND WHO HAVE AT LEAST FORTY PERCENT DISABILITY; AND DECLARING AN 6 EMERGENCY. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 36-401, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 36-401. HUNTING, TRAPPING, FISHING -- LICENSE REQUIREMENT -- EXCEPTIONS. 11 No person shall hunt, trap, or fish for or take any wild animal, bird or fish 12 of this state, without first having procured a license as hereinafter pro- 13 vided. Provided that no license shall be required: 14 (a) 1. For children under the age of fourteen (14) years who are resi- 15 dents of this state to fish during the open season therefor. 16 2. For nonresident children under the age of fourteen (14) years to fish 17 during the open season therefor provided they are accompanied by the 18 holder of a valid fishing license, and provided further that any fish 19 caught by such nonresident children shall be included in the bag and pos- 20 session limit of such license holder. 21 3. For resident children under the age of twelve (12) years to hunt, take 22 or kill predatory, unprotected birds and animals by means other than with 23 firearms. 24 4. For resident children under the age of fourteen (14) years to trap 25 muskrats from irrigation ditches or property on which they live during the 26 open season. 27 5. For children under the age of eighteen (18) years who are residents of 28 a licensed foster home, a foster group home, or a child welfare institu- 29 tion to fish during the open season therefor, provided they are accompa- 30 nied and supervised by the director, officer, or other employee of the 31 facility where the child resides. 32 (b) For any person to fish on a "free fishing day" as may be designated 33 by the commission. 34 (c) Institutional Inmates. For any inmate of the state hospital north, 35 state hospital south, Idaho state school and hospital, and state veterans 36 homes to fish during open seasons, provided said inmate has a permit therefor 37 from the director. The director is authorized to issue such permits upon the 38 request of the head of the respective institution having custody of said 39 inmate upon a showing that the institution recommends the issuance of such 40 permit and will assume full responsibility for and control over said inmate 41 while using said permit. 42 (d) Resident Military Personnel. For resident persons engaged in the mil- 43 itary service of the United States, while on temporary furlough or leave, upon 2 1 receipt of a temporary permit from the director, to hunt and fish during the 2 open season. 3 (e) State Juvenile Corrections Center Students. For students of the state 4 juvenile corrections center, under the supervision of an officer of the cen- 5 ter, to fish during the open season. 6 (f) Boy Scouts. For boy scouts who are official participants in atten- 7 dance at national or international encampments at Farragut State Park to take 8 fish during the encampment period from Lake Pend Oreille in such areas and 9 such numbers as may be designated by the commission. 10 (g) Participants in Fish and Game Sponsored Functions. For persons who 11 are official participants in attendance at official department sponsored func- 12 tions including clinics, courses or other educational events, while under the 13 supervision of a department approved instructor for the function, to fish dur- 14 ing any open season, provided that the instructor has been issued an educa- 15 tional fishing permit by the director. 16 (h) Disabled War Veterans. For disabled war veterans who have 17 resided in the state for not less than one (1) year immediately prior to the 18 date of application and who file with the director written proof that the last 19 official certification of record by the United States department of veterans 20 affairs or any branch of the armed forces of the United States shows the per- 21 son to be at least forty percent (40%) disabled. 22 (i) Nothing contained herein shall be construed to prohibit citi- 23 zens of the United States who are residents of the state of Idaho from carry- 24 ing arms for the protection of life and property. 25 SECTION 2. An emergency existing therefor, which emergency is hereby 26 declared to exist, this act shall be in full force and effect on and after its 27 passage and approval.
AMENDED STATEMENT OF PURPOSE S 1152 The purpose of this legislation is to provide for a complimentary fishing and hunting license for disabled veterans certified at a 40% disability or above as a result of a service connected injury. FISCAL NOTE The number of veterans who could qualify for this license is approximately 3,573. The Oregon Department of Fish and Wildlife recoups 601 of their matching federal funds thru the sale of game tags. Using the ratio of veterans that have applied for the disabled license in Oregon, the loss in revenue to the Fish and Game Department would be approximately $10,000. CONTACT: Sen.
