S1159|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1159 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO SOCIAL SECURITY NUMBERS; AMENDING SECTION 32-403, IDAHO CODE, TO 3 CLARIFY THE REQUIREMENTS FOR PROVIDING A SOCIAL SECURITY NUMBER ON AN 4 APPLICATION FOR A MARRIAGE LICENSE; AMENDING SECTION 73-122, IDAHO CODE, 5 TO CLARIFY THE REQUIREMENTS FOR PROVIDING A SOCIAL SECURITY NUMBER ON AN 6 APPLICATION FOR A PROFESSIONAL, OCCUPATIONAL OR RECREATIONAL LICENSE; AND 7 DECLARING AN EMERGENCY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 32-403, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 32-403. APPLICATION FOR AND ISSUANCE OF LICENSE. (1) Every county 12 recorder who shall have personal knowledge of the competency of the parties 13 for whose marriage a license is applied for, shall issue such license upon 14 payment or tender to him of his legal fee therefor; and if such recorder does 15 not know of his own knowledge that the parties are competent under the laws of 16 the state to contract matrimony, he shall take the affidavit in writing of the 17 person or persons applying for such license, and of other persons as he may 18 see proper, and of any persons whose testimony may be offered; and if it 19 appears from the affidavit so taken that the parties for whose marriage the 20 license in question is demanded are legally competent to marry, the recorder 21 shall issue such license, and the affidavits so taken shall be his warrant 22 against any fine or forfeiture for issuing such license. Provided, however, 23 that in the event either of the parties for whose marriage the license in 24 question is applied for is under the age of eighteen (18) years, the recorder 25 shall not issue such license except upon compliance with the consent and proof 26 of age requirements set forth in section 32-202, Idaho Code. 27 (2) Every application for a marriage license shall include the social 28 security numbers of the parties applying for the license. 29 (a) The requirement that an applicant provide a social security 30 number shall apply only to applicants who have been assigned a social 31 security number. 32 33 (b) An applicant who has not been assigned a social security number 34 shall: 35 36 (i) Present written verification from the social security 37 administration that the applicant has not been assigned a social 38 security number; and 39 40 (ii) Submit a birth certificate, passport or other documentary 41 evidence issued by an entity other than a state or the United States; 42 and 43 2 1 (iii) Submit such proof as the department may require that the 2 applicant is lawfully present in the United States. 3 SECTION 2. That Section 73-122, Idaho Code, be, and the same is hereby 4 amended to read as follows: 5 73-122. SOCIAL SECURITY NUMBER. (1) The social security 6 number of an applicant shall be recorded on any application for a profes- 7 sional, occupational or recreational license. 8 (2) The requirement that an applicant provide a social security 9 number shall apply only to applicants who have been assigned a social security 10 number. 11 (3) An applicant who has not been assigned a social security number 12 shall: 13 (a) Present written verification from the social security adminis- 14 tration that the applicant has not been assigned a social security number; 15 and 16 17 (b) Submit a birth certificate, passport or other documentary evi- 18 dence issued by an entity other than a state or the United States; and 19 20 (c) Submit such proof as the department may require that the appli- 21 cant is lawfully present in the United States. 22 SECTION 3. An emergency existing therefor, which emergency is hereby 23 declared to exist, this act shall be in full force and effect on and after its 24 passage and approval.
STATEMENT OF PURPOSE RS08953 Amends I.C. 32-403 (application for marriage license) and I.C. 73-122 (application for a professional, occupational or recreation license) to conform to the same standards as those for a drivers license. The change is to accommodate a licensing application alternative to the possession of a social security number. Legal aliens such as children or unemployed spouses of employed immigrants or migrant workers with credentials otherwise, cannot obtain a professional or occupational license, even though fully qualified. Current law requires that only a social security number may be used on an application. FISCAL NOTE No general funds need be used to implement this change. CONTACT: Sen.
