That Section 49-402, Idaho Code, be, and the same is hereby 16 amended to read as follows: 17 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 18 truck and each other motor vehicle having a maximum gross weight not in excess 19 of eight thousand (8,000) pounds, designed for the purpose of carrying passen- 20 gers and not used for hire shall be: 21 Vehicles one (1) and two (2) years old ............................ $48.00 22 Of the registration fees collected for vehicles one (1) and two (2) years 23 old, $36.48 shall be deposited to the highway distribution account and 24 $11.52 shall be deposited to the restricted highway fund. 25 Vehicles three (3) and four (4) years old ......................... $36.00 26 Of the registration fees collected for vehicles three (3) and four (4) 27 years old, $33.48 shall be deposited to the highway distribution account 28 and $2.52 shall be deposited to the restricted highway fund. 29 Vehicles five (5) and six (6) years old ........................... $36.00 30 Of the registration fees collected for vehicles five (5) and six (6) years 31 old, $26.28 shall be deposited to the highway distribution account and 32 $9.72 shall be deposited to the restricted highway fund. 33 Vehicles seven (7) and eight (8) years old ........................ $24.00 34 Of the registration fees collected for vehicles seven (7) and eight (8) 35 years old, $22.68 shall be deposited to the highway distribution account 36 and $1.32 shall be deposited to the restricted highway fund. 37 Vehicles over eight (8) years old ................................. $24.00 38 Of the registration fees collected for vehicles over eight (8) years old, 39 $16.08 shall be deposited to the highway distribution account and $7.92 40 shall be deposited to the restricted highway fund. 41 There shall be twelve (12) registration periods, starting in January for 42 holders of validation registration stickers numbered 1, and proceeding consec- 43 utively through December for holders of validation registration stickers num- 2 1 bered 12, each of which shall start on the first day of a calendar month and 2 end on the last day of the twelfth month from the first day of the beginning 3 month. Registration periods shall expire midnight on the last day of the reg- 4 istration period in the year designated by the validation registration 5 sticker. The numeral digit on the validation registration stickers shall, as 6 does the registration card, fix the registration period under the staggered 7 plate system of Idaho for the purpose of reregistration and notice of expira- 8 tion. 9 A vehicle that has once been registered for any of the above designated 10 periods shall, upon reregistration, be registered for the period bearing the 11 same number, and the registration card shall show and be the exclusive proof 12 of the expiration date of registration and licensing. Vehicles may be ini- 13 tially registered for less than a twelve (12) month period, or for more than a 14 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 15 tional registration tends to fulfill the purpose of the monthly series regis- 16 tration system. 17 (2) For all motor vehicles equipped to carry passengers and operated pri- 18 marily for hire exclusively within the limits of an incorporated city and 19 adjacent thereto, when the service outside the city is a part of a regular 20 service rendered inside the city, and for school buses operated either by a 21 nonprofit, nonpublic school or operated pursuant to a service contract with a 22 school district for transporting children to or from school or in connection 23 with school approved activities, the annual fee shall be twelve dollars and 24 forty-eight cents ($12.48). 25 (3) For all hearses, ambulances and wreckers the annual fee shall be 26 twenty-nine dollars and forty cents ($29.40), and these vehicles shall bear 27 passenger car plates. No operator of a hearse, ambulance, or wrecker shall be 28 entitled to operate them by virtue of any dealer's license that may have been 29 issued under the provisions of this chapter. 30 (4) For all motorcycles and all-terrain vehicles the annual fee shall be 31 nine dollars ($9.00). For operation of an ATV off the public highways, the fee 32 specified in section 67-7122, Idaho Code, shall also be paid. Registration 33 exemptions provided in section 49-426(2), Idaho Code, apply to all-terrain 34 vehicles and motorcycles used for the purposes described in that subsection 35 (2). 36 (5) For all motor homes the fee shall be as specified in subsection (1) 37 of this section and shall be in addition to the fees provided for in section 38 49-445, Idaho Code. 39 (6) Registration fees shall not be subject to refund. 40 (7) A financial institution or repossession service contracted to a 41 financial institution repossessing vehicles under the terms of a security 42 agreement shall move the vehicle from the place of repossession to the finan- 43 cial institution's place of business on a repossession plate. The repossession 44 plate shall also be used for demonstrating the vehicle to a prospective pur- 45 chaser for a period not to exceed ninety-six (96) hours. The registration fees 46 for repossession plates shall be as required in subsection (1) of this section 47 for a vehicle one (1) and two (2) years old. All other fees required under 48 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee. 49 The repossession plate shall be issued on an annual basis by the department. 50 (8) In addition to the annual registration fee in this section, there 51 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 52 program fee of fifteen dollars ($15.00) for all special license plate programs 53 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 54 49-409, 49-414, 49-416 and 49-418, Idaho Code. For special plates issued pur- 55 suant to sections 49-406 and 49-406A, Idaho Code, there shall be an initial 3 1 program fee of twenty-five dollars ($25.00) but there shall be no annual 2 renewal fee. For special plates issued pursuant to sections 49-417 , 3and49-417A, 49-418A, 49-419 and 49-420, 4 Idaho Code, there shall be an initial program fee of thirty-five dollars 5 ($35.00) and an annual program fee of twenty-five dollars ($25.00). The fees 6 contained in this subsection shall be applicable to all new special plate pro- 7 grams. The initial program fee and the annual program fee shall be deposited 8in the state highway account and shall be used to fund the cost of9administration of special license plate programs which are provided to the10public as a personal alternative to the standard license plate requirements11as specified by law for each program . 12 SECTION 2. That Section 49-417, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 49-417. IDAHO WILDLIFE SPECIAL PLATES. (1) Any person who is the owner of 15 a vehicle registered under the provisions of section 49-402 or 49-434(1), 16 Idaho Code, may apply for any one (1) of two (2) Idaho wildlife special 17 license plates. The provisions of this section shall not apply to any vehicle 18 with a registered maximum gross weight over sixteen thousand (16,000) pounds. 19 (2) In addition to the regular operating fee, the applicant shall be 20 charged a fee of thirty-five dollars ($35.00) for the initial issuance of the 21 plates, and twenty-five dollars ($25.00) upon each succeeding annual registra- 22 tion.Twenty-fiveTen dollars ($2523 10 .00) of the initial fee andfifteenten 24 dollars ($150 .00) of the renewal fee shall be depos- 25 ited in the state highway account and shall be used to fund the cost of admin- 26 istration of this special license plate program.Ten27 Twenty-five dollars ($1025 .00) of each ini- 28 tial fee andtenfifteen dollars ($10295 .00) of each renewal fee shall be deposited by the state 30 treasurer in the fish and game set-aside account pursuant to section 36-111, 31 Idaho Code, for use in the nongame wildlife program. This fee shall be 32 treated as a contribution to the nongame wildlife program, and shall not be 33 considered a motor vehicle registration fee as described in section 17, arti- 34 cle VII, of the constitution of the state of Idaho. 35 Whenever title or interest in a vehicle registered under the provisions of 36 this section is transferred or assigned, the owner may transfer the special 37 plates to another vehicle upon payment of the required transfer fees. He may 38 only display the plates after receipt of new registration from the department. 39 (3) Each Idaho wildlife license plate shall be of a color and design 40 acceptable to the board of directors of the Idaho fish and wildlife foundation 41 and approved by the department, utilizing a numbering system as determined by 42 the department. The Idaho fish and wildlife foundation is authorized to design 43 more than one (1) wildlife plate, but the department may not allow more than 44 two (2) different designs to be in use at any one (1) time. Initial costs of 45 the plate program including costs of plate design shall be paid by the Idaho 46 fish and wildlife foundation. 47 (4) Sample Idaho wildlife plates may be purchased for a fee of thirty 48 dollars ($30.00),twelveten dollars ($12490 .00) of which shall be deposited in the state highway 50 account to be used to fund the cost of administration of this special license 51 plate program.EighteenTwenty dollars ($185220 .00) of the purchase fee shall be deposited in the fish 53 and game set-aside account pursuant to section 36-111, Idaho Code, for use in 4 1 the nongame wildlife program. 2 SECTION 3. That Section 49-417A, Idaho Code, be, and the same is hereby 3 amended to read as follows: 4 49-417A. IDAHO TIMBER SPECIAL PLATES. (1) Any person who is the owner of 5 a vehicle registered under the provisions of section 49-402 or 49-434(1), 6 Idaho Code, may apply for Idaho timber special license plates. The provisions 7 of this section shall not apply to any vehicle with a registered maximum gross 8 weight over sixteen thousand (16,000) pounds. 9 (2) In addition to the regular operating fee, the applicant shall be 10 charged a fee of thirty-five dollars ($35.00) for the initial issuance of the 11 plates, and twenty-five dollars ($25.00) upon each succeeding annual registra- 12 tion.Twenty-fiveTen dollars ($2513 10 .00) of the initial fee andfifteenten 14 dollars ($150 .00) of the renewal fee shall be depos- 15 ited in the state highway account and shall be used to fund the cost of admin- 16 istration of this special license plate program.Ten17 Twenty-five dollars ($1025 .00) of each ini- 18 tial fee andtenfifteen dollars ($10195 .00) of each renewal fee shall be deposited by the state 20 treasurer in the department of lands fund for use in reforestation activities 21 on state lands, provided however, that prior to the beginning of any fiscal 22 year, the state board of land commissioners may agree that funds made avail- 23 able under this section to the department of lands for the coming year would 24 better further reforestation objectives of the management and conservation of 25 forest resources on public and private lands in the state if expended for edu- 26 cational efforts set forth in this section. 27 Whenever title or interest in a vehicle registered under the provisions of 28 this section is transferred or assigned, the owner may transfer the special 29 plates to another vehicle upon payment of the required transfer fees. He may 30 only display the plates after receipt of new registration from the department. 31 (3) The Idaho timber license plate shall be of a color and design accept- 32 able to the members of the Idaho forest products commission and approved by 33 the department, utilizing a numbering system as determined by the department. 34 Initial costs of the plate program, including costs of plate design, shall be 35 paid by the director of the department of lands from funds appropriated to 36 that department. 37 (4) Sample Idaho timber plates may be purchased for a fee of thirty dol- 38 lars ($30.00),twelveten dollars ($12390 .00) of which shall be deposited in the state highway 40 account andeighteentwenty dollars ($184120 .00) of which shall be deposited in the department of 42 lands fund for use in reforestation activities or educational efforts as set 43 forth in this section. 44 (5)TenTwenty-five dollars ($104525 .00) of each initial fee andtenfif- 46 teen dollars ($105 .00) of each renewal fee of 47 each timber special license plate, andeighteentwenty 48 dollars ($1820 .00) for each sample timber 49 special license plate, shall be deposited with the state treasurer and cred- 50 ited to the department of lands. Funds so deposited and subsequently directed 51 by the state board of land commissioners for educational efforts as set forth 52 in this section shall be expended as agreed by the state board of land com- 53 missioners upon recommendations developed jointly by the department of lands 5 1 and the Idaho forest products commission. Such efforts may include signs or 2 other appropriate means designed to help build public understanding of refor- 3 estation or the management and conservation of forest resources on public and 4 private lands in Idaho. 5 SECTION 4. That Section 49-418A, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 49-418A. IDAHO PUBLIC COLLEGE AND UNIVERSITY PLATES. (1) Any person who 8 is the owner of a vehicle registered under the provisions of section 49-402 or 9 49-434(1), Idaho Code, may apply for special plates featuring one (1) of 10 Idaho's public colleges or universities. The provisions of this section shall 11 not apply to any vehicle with a registered maximum gross weight over sixteen 12 thousand (16,000) pounds. Availability of Idaho public college and university 13 special license plates for other vehicles may be authorized by rule of the 14 board. 15 (2) In addition to the regular operating fee, the applicant shall be 16 charged a fee offiftythirty-five dollars ($ 3 17 50.00) for the initial issuance of the plates, and18fiftytwenty-five dollars ($ 2 5019.00) upon each succeeding annual registration.Twenty-five20 Ten dollars ($2510 .00) of the initial 21 fee andfifteenten dollars ($150 22 .00) of the renewal fee shall be deposited in the state highway account 23 to be used by the department to fund highway, road and bridge construction 24 projects and to fund the cost of administration of this special license plate 25 program. The department shall transfer twenty-five dollars ($25.00) of the 26 initial fee andthirty-fivefifteen dollars ($2731 5.00) of the renewal fee for deposit to the institution 28 designated on the license plate. 29 (3) Whenever title or interest in a vehicle registered under the provi- 30 sions of this section is transferred or assigned, the owner may transfer the 31 special plates to another vehicle upon payment of the required transfer fees. 32 The owner may only display the plates after receipt of new registration from 33 the department. 34 (4) All special college and university plates shall be of a color and 35 design comparable to the standard issue of license plates with blue numerals 36 on a red, white and blue background and shall indicate the participating 37 institution. 38 (a) The standard red, white and blue graphic shall be used, except that 39 the word "Idaho" and "Famous Potatoes" shall appear on every plate, the 40 identification of county shall be omitted, and the inscription "Scenic 41 Idaho" may be omitted. 42 (b) Each public college or university that chooses to participate in this 43 program shall provide that portion of the design which features the par- 44 ticular institution and such design shall be acceptable to the president 45 of the institution and the state board of education and board of regents 46 of the university of Idaho. 47 Each version of the special public college and university plate featuring 48 the participating public college or university shall be approved by the 49 department, utilizing a numbering system as determined by the department. Ini- 50 tial costs of the plate program, including the cost of plate design, shall be 51 paid by the participating public college or university. 52 (5) The state board of education and board of regents of the university 53 of Idaho shall adopt rules to account for receipt and distribution of revenues 6 1 accruing to participating public colleges and universities from the special 2 license plate program. Revenues from the special plate program shall be used 3 to: 4 (a) Fund scholarships for Idaho residents attending that college or uni- 5 versity. 6 (b) Match funds contributed in equal amounts from nonstate sources for 7 academic programs, provided that such expenditures shall be subject to 8 prior approval by the state board of education and board of regents of the 9 university of Idaho. 10 (6) Sample public college and university license plates may be purchased 11 from the department for a fee of thirty-fivedollars ($35120 .00),twelveten dollars 13 ($120 .00) of which shall be retained by the depart- 14 ment for deposit to the state highway account and twenty-three15 dollars ($230 .00) shall be transferred by the 16 department to the college or university designated on the license plate. No 17 additional fee shall be charged for personalizing sample plates. 18 SECTION 5. That Section 49-419, Idaho Code, be, and the same is hereby 19 amended to read as follows: 20 49-419. IDAHO SNOWSKIER PLATES. (1) On and after January 1, 1999, any 21 person who is the owner of a vehicle registered under the provisions of sec- 22 tion 49-402, Idaho Code, or registered under any other section of law for 23 which the purchase of special plates is allowed, may apply for and upon 24 department approval receive special Idaho snowskier license plates in lieu of 25 regular license plates. Availability of Idaho snowskier license plates for 26 other vehicles shall be subject to the rules, policies and procedures of the 27 department. 28 (2) In addition to the regular registration fee required in chapter 4, 29 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol- 30 lars ($35.00) for the initial issuance of the plates, and twenty-five dollars 31 ($25.00) upon each succeeding annual registration.Twenty-five32 Ten dollars ($2510 .00) of the initial 33 fee andfifteenten dollars ($1534 0 .00) of the renewal fee shall be deposited in the state highway 35 account and shall be used to fund the cost of administration of this special 36 license plate program.TenTwenty-five dollars 37 ($1025 .00) of each initial fee andten38 fifteen dollars ($105 .00) of each 39 renewal fee shall be deposited by the state treasurer in the division of tour- 40 ism fund within the department of commerce for use in the 2002 Olympic winter 41 games strategy program and for general promotion of Idaho's ski industry. 42 (3) Whenever title or interest in a vehicle registered under the provi- 43 sions of this section is transferred or assigned, the owner may transfer the 44 special plates to another vehicle upon payment of the required transfer fees. 45 The owner may only display the plates on another vehicle upon receipt of the 46 new registration from the department. 47 (4) The Idaho snowskier license plate shall be of a color and design com- 48 parable to the standard issue of license plates with blue numerals on a red, 49 white and blue background, except that the word "Idaho" shall appear on each 50 plate and the county designator shall be omitted to provide for distinguishing 51 designs and slogans, acceptable to the Idaho ski areas association, to be 52 added to the plate. The design shall be approved by the department and shall 53 utilize a numbering system as determined by the department. Initial costs of 7 1 the plate program, including costs of plate design, shall be paid by the Idaho 2 ski areas association. 3 (5) Sample Idaho snowskier license plates may be purchased for a fee of 4 thirty dollars ($30.00),twelveten dollars ($1520 .00) of which shall be deposited in the state highway 6 account andeighteentwenty dollars ($18720 .00) of which shall be deposited in the division of tour- 8 ism fund within the department of commerce for use in the 2002 Olympic winter 9 games strategy program and for general promotion of Idaho's ski industry. No 10 additional fee shall be charged for personalizing sample plates. 11 SECTION 6. That Section 49-420, Idaho Code, be, and the same is hereby 12 amended to read as follows: 13 49-420. IDAHO SNOWMOBILE PLATES. (1) On and after January 1, 1999, any 14 person who is the owner of a vehicle registered under the provisions of sec- 15 tion 49-402, Idaho Code, or registered under any other section of law for 16 which the purchase of special plates is allowed, may apply for and upon 17 department approval receive special Idaho snowmobile license plates in lieu of 18 regular license plates. Availability of Idaho snowmobile license plates for 19 other vehicles shall be subject to the rules, policies and procedures of the 20 department. 21 (2) In addition to the regular registration fee required in chapter 4, 22 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol- 23 lars ($35.00) for the initial issuance of plates, and twenty-five dollars 24 ($25.00) upon each succeeding annual registration.Twenty-five25 Ten dollars ($2510 .00) of the initial 26 fee andfifteenten dollars ($1527 0 .00) of the renewal fee shall be deposited in the state highway 28 account and shall be used to fund the cost of administration of this special 29 license plate program.TenTwenty-five dollars 30 ($1025 .00) of each initial fee andten31 fifteen dollars ($105 .00) of each 32 renewal fee shall be deposited by the state treasurer in the Idaho department 33 of parks and recreation state snowmobile account established pursuant to sec- 34 tion 67-7106, Idaho Code. 35 (3) Whenever title or interest in a vehicle registered under the provi- 36 sions of this section is transferred or assigned, the owner may transfer the 37 special plates to another vehicle upon payment of the required transfer fees. 38 The owner may only display the plates on another vehicle upon receipt of the 39 new registration from the department. 40 (4) The Idaho snowmobile license plate shall be of a color and design 41 comparable to the standard issue of license plates with blue numerals on a 42 red, white and blue background, except that the word "Idaho" shall appear on 43 each plate and the county designator shall be omitted to provide for distin- 44 guishing designs and slogans, acceptable to the Idaho state snowmobile associ- 45 ation, to be added to the plate. The design shall be approved by the depart- 46 ment and shall utilize a numbering system as determined by the department. 47 Initial costs of the plate program, including costs of plate design, shall be 48 paid by the Idaho state snowmobile association. 49 (5) Sample Idaho snowmobile license plates may be purchased for a fee of 50 thirty dollars ($30.00),twelveten dollars ($15120 .00) of which shall be deposited in the state highway 52 account andeighteentwenty dollars ($185320 .00) of which shall be deposited in the state snowmobile 8 1 account within the department of parks and recreation. No additional fee shall 2 be charged for personalizing sample plates.

STATEMENT OF PURPOSE RS08929 Tlus legislation enables the programs for which certain special license plates were created to realize the maximum benefit for those programs from the sale of the respective special plates. This legislation will not increase the cost to citizens of special plates dedicated to funding specific programs, ie wildlife, snowv skier, snowmobile, timber and university, but will enable the amount deposited in special accounts dedicated to each program to increase, while allowing the Idaho Department of Transportation to recover estimated costs of administering the respective programs. Ten dollars ($10.00) of the cost of each special plate will be deposited in the state highway account to administer the program The balance of the cost of each plate will be deposited in the respective accounts pertaining to each special plate. FISCAL NOTE The Idaho Department of Transportation estimates cost of administering these special plate prograrns to be approximately $10.00 per plate. This legrslation allocates the distribution of funds in a manner which more accurately reflects actual costs. While no fiscal impact is estimated for the cost of administration by the Idaho Department of Transportation, the revenues generated to the specific prograrns for which the plates were authorized may increase by as much as 190%. This increase can be used by the respective programs funded by tne special plates to offset general account expenditures, increase federal match for programs, increase scholarships for Idaho students, provide for recreational opportunities or promote Idaho tourism.
