                                   SENATE BILL NO. 1184

                             BY HEALTH AND WELFARE COMMITTEE

 1                                        AN ACT
 2    RELATING TO TATTOO PARLORS; AMENDING SECTION 39-2001, IDAHO  CODE,  TO  CHARGE
 3        THE  DIRECTOR  OF  THE  DEPARTMENT OF HEALTH AND WELFARE TO INSPECT TATTOO
 4        PARLORS; AND AMENDING SECTION 39-2003, IDAHO CODE,  TO  PROVIDE  PENALTIES
 5        AND TO MAKE A TECHNICAL CORRECTION.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Section 39-2001, Idaho Code, be, and the same is hereby
 8    amended to read as follows:

 9        39-2001.  JURISDICTION OF DIRECTOR. In the interest of the  public  health
10    and  to prevent the spread of contagious and infectious diseases, the director
11    of the department of health and welfare is charged with the sanitary  supervi-
12    sion  of  all barber shops, hairdressing parlors,  tattoo parlors, 
13    retail cosmetics dealers, public bathhouses, public bathrooms and public bath-
14    ing places in the state of Idaho.

15        SECTION 2.  That Section 39-2003, Idaho Code, be, and the same  is  hereby
16    amended to read as follows:

17        39-2003.  CERTIFICATE  OF  COMPLIANCE.  Upon any such establishment herein
18    being found to be in a sanitary condition, by the director, and complying with
19    the  regulations   rules  provided for in the  preceding
20    section, a certificate shall be issued by said director without any cost, good
21    for  the year in which it is issued, which shall be kept posted in a conspicu-
22    ous place. The owner, lessee, or manager of any barber shop, hairdressing par-
23    lor,  tattoo parlor,  retail  cosmetics  dealer,  public  bathroom,
24    bathhouse,  or  bathing  resort who operates his business in violation of this
25    provision shall be guilty of a misdemeanor and punished  as  provided  in  the
26    preceding section.

STATEMENT OF PURPOSE

RS09051

Regarding public health and safety, this proposal would place Tattoo Parlors in the same title and chapter as Barber Shops and Beauty Salons regarding sanitary inspections. There have been numerous serious infections arise out of tattoo parlors in our state.

No fiscal Impact to the general fund.
