PEACE OFFICER - FIREFIGHTER - DEPENDENT SCHOLARSHIP - Amends existing law
to provide that dependents of full-time peace officers or firefighters
killed or disabled in the line of duty shall be eligible to attend any
public institution of higher education or public vocational-technical
college without payment of tuition, fees, housing, meals, books, equipment
and supplies for a specified period of time; and to provide financial
limits and application for eligibility.

                                   SENATE BILL NO. 1191

 1                                        AN ACT
 2    RELATING TO SCHOLARSHIPS; AMENDING SECTION 33-4302A, IDAHO  CODE,  TO  PROVIDE
 3        THAT DEPENDENTS OF FULL-TIME PEACE OFFICERS OR FIREFIGHTERS KILLED OR DIS-
 4        ABLED  IN THE LINE OF DUTY SHALL BE ELIGIBLE TO ATTEND ANY PUBLIC INSTITU-
 5        TION OF HIGHER EDUCATION OR PUBLIC  VOCATIONAL-TECHNICAL  COLLEGE  WITHOUT
 6        PAYMENT  OF  TUITION,  FEES, HOUSING, MEALS, BOOKS, EQUIPMENT AND SUPPLIES
 7        FOR A SPECIFIED PERIOD OF TIME, TO PROVIDE FINANCIAL LIMITS AND TO PROVIDE
 8        FOR APPLICATION FOR ELIGIBILITY.

 9    Be It Enacted by the Legislature of the State of Idaho:

10        SECTION 1.  That Section 33-4302A, Idaho Code, be, and the same is  hereby
11    amended to read as follows:

12        33-4302A.    PEACE  OFFICER/FIREFIGHTER DEPENDENT  SCHOLARSHIPS
13    -- STATE AID.  (1)   Any dependent of a full-time peace officer  or
14    firefighter  employed  in Idaho, which officer or firefighter is a resident of
15    the state of Idaho and which officer or firefighter is killed or  disabled  in
16    the  line of duty shall be admitted to attend any public institution of higher
17    education or public vocational-technical   school      college
18      within  the state of Idaho without the necessity of paying tuition and
19    fees  in an amount not to exceed eight hundred dollars ($800) and  
20     therefor. Said dependents  shall be provided  by the institu-
21    tion  or  college  with books, equipment and supplies necessary for pur-
22    suit of  their   the  dependent's  chosen    program  of
23    enrollment not to exceed  three   the actual cost therefor, or
24    five    hundred dollars ($ 3  5 00),   which-
25    ever is less,  per quarter, semester, intensified semester, or like edu-
26    cation period.  Said dependent shall be provided with the institution  or
27    college's  published  normal  on-campus residential facility housing and meals
28    program for each month the dependent is enrolled full time under this  statute
29    and  continues to actually reside in such on-campus residential facility. Pro-
30    vided however, that the educational benefits  provided  for  in  this  section
31    shall  not  exceed  a  total  of thirty-six (36) months or four (4) nine-month
32    periods. 
33         (2)   The dependent shall be required to meet the  educational
34    qualifications as such institution of higher education or vocational-technical
35      school   college  as established for other prospective
36    students of this state.  Application for eligibility under  this  section
37    shall be made to the state board of education and board of regents of the Uni-
38    versity  of Idaho. The board shall verify the eligibility of the dependent and
39    communicate such eligibility to the dependent and the affected institution  or
40    college. 
41          (3)    Affected institutions  and colleges  shall,
42    in their preparation of future budgets, include therein costs  resulting  from
43    such tuition, fees,  housing, meals,  books, equipment and supplies

 1    for reimbursement thereof from appropriation of state funds.
 2        For the purposes of this section, a peace officer or firefighter, employed
 3    in  Idaho,  is considered disabled if he or she is unable to perform with rea-
 4    sonable continuity the material duties of any gainful occupation for which  he
 5    or she is reasonably fitted by education, training and experience.

                       STATEMENT OF PURPOSE

The purpose of this bill is to expand the benefits received
by the dependent children of peace officers and firefighters
killed or disabled, as defined in the bill, in the line of duty
in Idaho. This bill will bring the level of benefits on a level
consistent with other benefits for dependents of POW/MIA
Idahoans. The bill provides for the costs (all fees, books, room
and board) of eligible dependents pursuing a vocational
technical or undergraduate education at an Idaho public college

                            FISCAL NOTE


It is difficult to estimate the number of peace officer or
firefighter dependents that might eventually be eligible for
benefits under this legislation. Since the original legislation
was enacted, only three dependents have used the benefit. It
currently costs approximately $7,200 annually to attend an Idaho
public four-year institution ($2,200 in fees, $1,000 for books
and $4,000 for room and board). The costs are generally less for
community colleges. With this amendment to the legislation, if
one dependent was eligible each year to receive benefits under
this legislation, the annual cost to the state would be $7,200.
