That Section 33-4802, Idaho Code, be, and the same is hereby 16 amended to read as follows: 17 33-4802. FINDINGS. The legislature hereby finds, determines and declares 18 that the state of Idaho recognizes the importance of applying technology to 19 meet the public need for an improved ,andthorough 20 and seamless public education system for elementary and secondary 21 education, education of the hearing or visually impaired at the Idaho school 22 for the deaf and blind, post-secondary and higher education and public librar- 23 ies. 24 SECTION 2. That Section 33-4803, Idaho Code, be, and the same is hereby 25 amended to read as follows: 26 33-4803. DEFINITIONS. As used in this chapter: 27 (1) "Educational segments" are, individually, the public elementary and 28 secondary school system, the Idaho school for the deaf and blind, the voca- 29 tional education system, the community colleges, and the four-year colleges 30 and universities. 31 (2)"IPBS" means the Idaho public broadcasting service.3233(3) "Instructional video service providers" means publicly and pri-34vately funded television agencies that offer instructional video programming35and services without commercial advertising.3637(4)"Libraries" means district, city,and38 school/community libraries , and the state library as described in 39 chapters 25, 26 and 27, title 33, Idaho Code. 40 (53 ) "Technology" meanstechnology-based41materials, equipment, systems, and networksall present and 2 1 future forms of computer hardware, computer software and services used or 2 required for automated data processing, computer-related office automation or 3 telecommunications . 4 (4) "Telecommunications" means all present and future forms of 5 hardware, software or services used or required for transmitting voice, data, 6 video or images over a distance. 7 SECTION 3. That Section 33-4804, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 33-4804. STATE COUNCIL FOR TECHNOLOGY IN LEARNING CREATED -- MEMBERSHIP. 10 (1) There is hereby created and established the state council for technology 11 in learning under the state board of education, referred to herein as the 12 council. 13 (2) The council shall consist offifteenfourteen 14 (154 ) members who shall be appointed as fol- 15 lows: 16 (a) The superintendent of public instruction, or his designee. The 17 superintendent of public instruction shall appoint one (1) practicing pub- 18 lic school administrator as a member. 19 (b) The governor shall appointone (1) practicing public school20administrator, onetwo (12 ) 21 business /private sector representative s with 22 experience in applications of technology,one (1) representative of23the division of vocational education, one (1) vocational/applied technol-24ogy teacher, one (1) practicing public school teacher, one (1) public25librarian, one (1) public school media specialist, one (1) member of the26state board of education,and one (1)member of the faculty27of a public higher education institutionperson who is a mem- 28 ber of a local school board as provided in chapter 5, title 33, Idaho 29 Code. Such local school board member shall be appointed by the governor 30 from a list of not less than three (3) nor more than five (5) names sub- 31 mitted by the statewide association representing local school board mem- 32 bers . 33 (c) The president pro tempore of the Idaho senate shall appoint two (2) 34 members of the senate, one (1) from each of the two (2) largest political 35 parties. 36 (d) The speaker of the house of representatives shall appoint two (2) 37 members of the house of representatives, one (1) from each of the two (2) 38 largest political parties. 39 (e)The chairA representative of the40state board of education's telecommunications councilhigher 41 education information technology committee as provided in section 33-4809, 42 Idaho Code, and a representative of the public education information tech- 43 nology committee as provided in section 33-4810, Idaho Code . 44 (f) The state board of education shall appoint one (1) of its mem- 45 bers as a member of the council. In addition, the state board of education 46 shall appoint one (1) member who is currently serving as president of an 47 Idaho public college or university. The executive director of the state 48 board of education as appointed pursuant to section 33-102A, Idaho Code, 49 shall serve as a member of the council. 50 51 (g) The state board of education shall select from among the mem- 52 bers of the council a chairman who shall call and conduct the meetings of 53 the council pursuant to policies adopted by the council and approved by 3 1 the state board of education. 2 (3)Members appointed by the governor and legislative leadership3At the first meeting of the council after the effective date of 4 this act, the members shall draw by lottery to determine one-half (1/2) of the 5 members to serve an initial term of two (2) years and one-half (1/2) of the 6 members to serve an initial term of four (4) years. Thereafter, all members 7 shall serve a term of four (4) years but may be removed prior to 8 the expiration of a term at the pleasure of the appointing official. 9 Notwithstanding any other provision of law to the contrary, any member 10 of the council may succeed himself in appointment. 11 (4) Members of the council shall receive compensation as provided in sec- 12 tion 59-509(b), Idaho Code. 13 SECTION 4. That Section 33-4805, Idaho Code, be, and the same is hereby 14 amended to read as follows: 15 33-4805. RESPONSIBILITIES OF THE COUNCIL -- COUNCIL STAFF. (1) 16 Staff support for the council shall be drawn from theagencies17and institutions under and affiliated with the state board of education18including, but not limited to, the colleges and universities, community col-19leges, technical colleges, division of vocational education, department of20education, Idaho public television, state library and office of the state21board of educationeducational segments as recommended by the 22 council and approved by the state board of education. The legislative intent 23 is to provide broad representation of the various educational segments with 24 the council staff . 25 (2) The council shall have the following responsibilities: 26 (a) Develop and maintain a statewide education technology plan to 27 provide seamless education in Idaho. Such plan shall be subject to annual 28 review and approval by the state board of education. 29 (1b ) Make recommendations to the state board of 30 education on educational technology and telecommunications 31 plans, policies, programs and activities for all educational seg- 32 ments . 33 (2c ) Subject to the approval of the state board 34 of education, administer and develop standards and criteria for the public 35 school technology grants program provided for in section 33-4806, Idaho 36 Code. 37 (3d ) Ensure that therecommendations38made in "Telecomm 92" are consideredpolicies set by the 39 information technology resource management council are followed in accor- 40 dance with sections 67-5745B and 67-5745C, Idaho Code, in imple- 41 menting educational technology programs pursuant to this chapter. 42 (4e ) Collaborate with all educa- 43 tionalinstitutions, including libraries, public schools, higher44education, technical and community collegessegments , 45 as well as with professional education associations,46and businesses , in recommending priorities for fund- 47 ing and in identifying needs for technology use in education. 48 (5f ) Recommend to the state board of education, 49 standards and procedures for the administration of this act, including, 50 but not limited to, standards for technology-based resources, projects, 51 programs, practices or products to be adopted or adapted, and standards 52 and criteria by which to evaluate the technology-based programs. 53(6)In addition, the council shall rR4 1ecommend exemplary programs, practices, or products based on the 2 criteria established in this subsection .3(5) of this section.4 (7g ) Recommend priorities for uses of educa- 5 tional technology. 6 (8h ) Work with representatives of the governing 7 bodies of the educational segments to develop recommendations or strate- 8 gies for the coordination, administration, and evaluation of educational 9 technology programs and resources. 10 (9i ) Work with representatives of the governing 11 bodies of the educational segments to identify strategies to coordinate 12 statewide voice, video, and data telecommunications systems that may be 13 accessed by the educational segments. 14 (10j ) To review, evaluate and build upon the 15 educational technology projects in public schools funded through other 16 state initiatives. 17 (k) To form such subcommittees or task forces as it deems necessary 18 to review matters pertaining to a particular educational segment or to any 19 other issues before the council. 20 SECTION 5. That Section 33-4807, Idaho Code, be, and the same is hereby 21 amended to read as follows: 22 33-4807. EVALUATIONS AND AUDITS.On or before July 1, 1995, t23T he legislative services office shall ,24initiate an interim evaluation offrom time to time as directed 25 by the legislature, evaluate and audit the relative impact, costs and 26 benefits of each of the educational technology programs conducted 27 pursuant tothe appropriations made for the Idaho educational technology28initiative during the second regular session of the fifty-second legislature.29The evaluation results shall be reported to the governor, legislature, and30state board of education on or before January 1, 1996. On or before July 1,311996, the state board of education shall initiate a comprehensive evaluation32of the relative impact, costs and benefits of each of the programs conducted33pursuant to the appropriations made for the Idaho educational technology ini-34tiative during the second regular session of the fifty-second legislature. The35evaluation results shall be reported to the governor and the legislature on or36before July 1, 1997this chapter. The state board of education 37 shall report to the legislature and the governor each year on or before Octo- 38 ber 1 as to the relative impact, cost and benefit of the educational technol- 39 ogy program conducted pursuant to this chapter . 40 SECTION 6. That Chapter 48, Title 33, Idaho Code, be, and the same is 41 hereby amended by the addition thereto of a NEW SECTION , to be 42 known and designated as Section 33-4809, Idaho Code, and to read as follows: 43 33-4809. HIGHER EDUCATION INFORMATION TECHNOLOGY COMMITTEE. The state 44 board of education shall establish a standing subcommittee of the council to 45 be known as the higher education information technology committee the purpose 46 of which is to advise the council regarding postsecondary and other education 47 technology and telecommunications issues pertinent to the purposes of this 48 chapter that affect educational segments not including primary and secondary 49 education. 50 SECTION 7. That Chapter 48, Title 33, Idaho Code, be, and the same is 5 1 hereby amended by the addition thereto of a NEW SECTION , to be 2 known and designated as Section 33-4810, Idaho Code, and to read as follows: 3 33-4810. PUBLIC EDUCATION INFORMATION TECHNOLOGY COMMITTEE. The state 4 board of education shall, upon consideration of the recommendations of the 5 superintendent of public instruction, establish a standing subcommittee of the 6 council to be known as the public education information technology committee, 7 the purpose of which is to advise the council regarding only primary and sec- 8 ondary education technology and telecommunications issues pertinent to this 9 chapter. At a minimum, and not by way of limitation, the public education 10 information technology committee membership shall include one (1) vocational 11 education/applied technology teacher, one (1) public librarian, one (1) public 12 school media specialist, and one (1) public school teacher.
STATEMENT OF PURPOSE RS 08959 The purpose of this legislation is to modify the membership and clarify the duties of the Idaho Council for Technology in Learning (ICTL). The bill changes the membership of the committee and allows the Superintendent of Public Instruction, the Governor and the State Board of Education to appoint various members. Four members of the Legislature, two from the House and two from the Senate are also members. The bill then clarifies that the ICTL will be the technology advisory body to the State Board of Education for both K-12 education and higher education, instead of its current role of specializing in K-12 technology. The final change is to establish standing committees of ICTL, one to specialize in K-12 and the other to specialize in higher education and other matters, to report and advise the ICTL on its various duties. FISCAL IMPACT The fiscal impact of the present Idaho Council for Technology in Learning is $140,000.00 annually. With the passage of this Legislation, the new ICTL budget would require an additional $39,000.00 per year. This would increase a .5 secretary to fulltime and pay expenses for the additional subcommittees. Total annual budget would be $173,000.00.
