S1208|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1208 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO BEES; AMENDING SECTION 22-2526, IDAHO CODE, TO REQUIRE EVERY BEE- 3 KEEPER TO OBTAIN A PERMIT AND TO MAKE TECHNICAL CORRECTIONS; AMENDING SEC- 4 TION 22-2529, IDAHO CODE, TO CLARIFY REQUIREMENTS FOR A PERMIT BY A 5 "QUALIFIED BISTATE BEEKEEPER" AND TO MAKE TECHNICAL CORRECTIONS; AND 6 AMENDING SECTION 22-2530, IDAHO CODE, TO SPECIFY QUALIFICATIONS FOR A PER- 7 MIT AS A "QUALIFIED BISTATE BEEKEEPER" AND TO MAKE TECHNICAL CORRECTIONS. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 22-2526, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 22-2526. IMPORTATION OF BEES -- PERMIT REQUIREMENTS. Any beekeeper who is 12not a "qualified bi-state beekeeper"desiring to move bees into 13 Idaho shall, before bringing such bees into said state, be required to obtain 14 a permit from the director. Before such a permit will be issued, a certificate 15 of health must be obtained from the state of origin showing lack of foulbrood, 16 or other infectious or contagious disease in said bees, combs, hives or bee- 17 keeping equipment, and be delivered to the director. There shall be a permit 18 charge of twenty-five cents (25[) per colony for each colony of bees moved 19 into the state of Idaho. This amount shall be paid to the state of Idaho by 20 the beekeeper prior to the movement. A pPermit 21 issued hereunder shall expire six (6) months from date of issuance. 22 SECTION 2. That Section 22-2529, Idaho Code, be, and the same is hereby 23 amended to read as follows: 24 22-2529. ACT CONSTRUED TO PERMIT TRANSPORTATION OF BEES -- PERMIT.25This act shall not be construed to prevent the transportation across the Idaho26state line of bees in hives, or bee supplies and equipment, between bee yards27owned by, or under the control of aA "qualifiedbi-28statebistate beekeeper."However, such29transportation shall not be lawful unless a general and continuing30 may transport across the Idaho state line, bees in hives, or bee sup- 31 plies and equipment, between bee yards owned by, or under the control of the 32 beekeeper if he holds a permit therefor ashereinafter33 provided in section 22-2530, Idaho Code,shall have been first obtained34from the director,and such permit may be revoked by the director upon 35 a showing that such privilege has been or is being abused. Bee colonies in 36 transit through Idaho shall be netted while within the borders of Idaho and no 37 such bees shall beoff loadedoffloaded in Idaho 38 without full compliance of the laws. 39 SECTION 3. That Section 22-2530, Idaho Code, be, and the same is hereby 40 amended to read as follows: 2 1 22-2530. ANNUALGENERAL AND CONTINUINGPERMIT. An annual 2general and continuingpermit shall be issued to a "qualified 3bi-statebistate beekeeper" by the director upon 4 receipt of an annual application and a report of a satisfactory 5 inspection by the director's designated agent as to the health 6 and condition of the applicant'sIdahobee colonies.
STATEMENT OF PURPOSE RS09003 The purpose of this legislation is to ensure that all bees entering Idaho are inspected to reduce the negative impacts of bugs and diseases. FISCAL NOTE There could be an impact to the Ag Departments budget as a result of the requirement to inspect all bees entering Idaho.
