S1231|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1231 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO QUALIFICATIONS FOR COUNTY SHERIFF; AMENDING SECTION 34-618, IDAHO 3 CODE, TO REQUIRE SHERIFFS TO HAVE SUCCESSFULLY MET THE REQUIREMENTS FOR A 4 BASIC CERTIFICATE FROM THE IDAHO POLICE STANDARDS AND TRAINING ACADEMY FOR 5 SHERIFFS ELECTED ON AND AFTER 2000. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 34-618, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 34-618. ELECTION OF COUNTY SHERIFFS -- QUALIFICATIONS. (1) At the general 10 election,19722000 , and every four (4) years there- 11 after, a sheriff shall be elected in every county. 12 (2) No person shall be elected to the office of sheriff unless he has 13 attained the age of twenty-one (21) years at the time of his election, is a 14 citizen of the United States ,andshall have resided 15 within the county one (1) year next preceding his election and has suc- 16 cessfully met the requirements for a basic certificate from the Idaho police 17 standards and training academy . 18 (3) Each candidate shall file his declaration of candidacy with the 19 county clerk. 20 (4) Each candidate who files a declaration of candidacy shall at the same 21 time pay a filing fee of forty dollars ($40.00) which shall be deposited in 22 the county treasury.
STATEMENT OF PURPOSE RS 09021 The purpose of this legislation is to provide for minimal qualifications for the office of sheriff. Currently, there are no requirements for the office of sheriff, not even a criminal background check. The Idaho Sheriffs' Association feels it is time to ensure that sheriffs have certain primary law enforcement experience and do not have criminal backgrounds. FISCAL IMPACT There is no fiscal impact to the state or its political subdivisions.
