STATE PROJECTS - FINANCING - Amends existing law to provide that, during
the interim between regular legislative sessions, approval may be given by
the State Board of Examiners, with the President Pro Tempore of the Senate
and the Speaker of the House of Representatives concurring, to authorize a
state body to have the State Building Authority provide a specific
facility.

S1245|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1245 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE STATE BUILDING AUTHORITY; AMENDING SECTION 67-6410, IDAHO 3 CODE, TO PROVIDE THAT DURING THE INTERIM BETWEEN REGULAR LEGISLATIVE SES- 4 SIONS APPROVAL MAY BE GIVEN BY THE STATE BOARD OF EXAMINERS WITH THE PRES- 5 IDENT PRO TEMPORE OF THE SENATE AND THE SPEAKER OF THE HOUSE OF REPRESEN- 6 TATIVES CONCURRING TO AUTHORIZE A STATE BODY TO HAVE AUTHORITY TO PROVIDE 7 A SPECIFIC FACILITY; AND DECLARING AN EMERGENCY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 67-6410, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 67-6410. PROCEDURE PRIOR TO FINANCING BUILDING DEVELOPMENTS OR BUILDING 12 PROJECTS. Notwithstanding any other provision of this act, the authority is 13 not empowered to finance any facility pursuant to section 67-6409, Idaho Code, 14 unless: 15 (a) Prior approval by the legislature has been given by concurrent reso- 16 lution authorizing a state body to have the authority provide a specific 17 facility or, during the interim between regular legislative sessions, 18 approval has been given by the state board of examiners with the president pro 19 tempore of the senate and the speaker of the house of representatives concur- 20 ring therein authorizing a state body to have the authority provide a specific 21 facility ; 22 (b) A state body has entered into an agreement with the authority for the 23 authority to provide a facility; 24 (c) The authority finds that the building development or building project 25 to be assisted pursuant to the provisions of this act, will be of public use 26 and will provide a public benefit. 27 SECTION 2. An emergency existing therefor, which emergency is hereby 28 declared to exist, this act shall be in full force and effect on and after its 29 passage and approval.

STATEMENT OF PURPOSE

This legislation provides an effective administrative and
legislative oversight mechanism to approve issuance of bonds by the
Idaho State Building Authority during the interim between regular
legislative sessions to purchase or construct state facilities.
FISCAL NOTE
No fiscal impact.
Albeit, the basis for the Board of Examiners, Pro Tem and Speaker
of the House approving issuance of bonds by the State Building
Authority will be clear evidence that significant long-term savings
of taxpayer dollars is available.
