S1265|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1265 BY FINANCE COMMITTEE 1 AN ACT 2 APPROPRIATING MONEYS TO THE DEPARTMENT OF HEALTH AND WELFARE FOR MEDICAL 3 ASSISTANCE SERVICES FOR FISCAL YEAR 2000; PROVIDING THAT THE STATE CON- 4 TROLLER SHALL MAKE TRANSFERS FROM THE GENERAL FUND; REAPPROPRIATING CER- 5 TAIN UNEXPENDED AND UNENCUMBERED BALANCES OF MONEYS; AUTHORIZING THE 6 EXPENDITURE OF ALL RECEIPTS COLLECTED; EXPRESSING LEGISLATIVE INTENT WITH 7 REGARD TO IDAHO'S HOME AND COMMUNITY-BASED SERVICES WAIVER; EXPRESSING 8 LEGISLATIVE INTENT WITH REGARD TO THE CHILD HEALTH INSURANCE PROGRAM; AND 9 EXPRESSING LEGISLATIVE INTENT WITH REGARD TO THE CHILDREN'S HEALTH INSUR- 10 ANCE PROGRAM TASK FORCE RECOMMENDATIONS. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. As appropriated, the State Controller shall make transfers of 33 the General Fund to the Cooperative Welfare Fund, periodically, as requested 34 by the Director of the Department of Health and Welfare and approved by the 35 Board of Examiners. 36 SECTION 3. There is hereby reappropriated to the Department of Health and 37 Welfare for Medical Assistance Services any unexpended and unencumbered bal- 38 ances of the Cooperative Welfare Fund as appropriated for Medical Assistance 39 Services for fiscal year 1999, to be used for nonrecurring expenditures only 40 for the period July 1, 1999, through June 30, 2000. The reappropriation shall 41 be computed by the Department of Health and Welfare from available moneys. 2 1 SECTION 4. Notwithstanding the provisions of Section 67-3516(2), Idaho 2 Code, the Department of Health and Welfare for Medical Assistance Services is 3 hereby authorized to expend all receipts collected in Medical Assistance Ser- 4 vices as noncognizable funds for the period July 1, 1999, through June 30, 5 2000. 6 SECTION 5. Section 5, Chapter 346, Laws of 1998, authorized lifting the 7 cap imposed on Idaho's Home and Community-Based Services (HCBS) waiver. This 8 authorization was predicated on HCBS services being no more expensive than 9 services in an Intermediate Care Facility for the Mentally Retarded (ICF/MR) 10 setting. Because HCBS services per individual have been proven to be less 11 expensive than ICF/MR services and because there is a list of eligible indi- 12 viduals waiting to receive these services, the Department of Health and Wel- 13 fare is directed to provide those qualified individuals with waivered ser- 14 vices. In addition, the Legislature directs the department to utilize appro- 15 priate HCBS services first before considering the placement of an individual 16 in an ICF/MR setting. The department is further directed to provide the Joint 17 Finance-Appropriations Committee with a periodic report on its progress 18 towards implementing this directive. 19 SECTION 6. It is the intent of the Idaho Legislature that the federal 20 Title XXI Child Health Insurance Program, as appropriated in Section 1 of this 21 act, not exceed $4.2 million in General Fund expenditures for the period July 22 1, 1999, through June 30, 2000. In addition, the Director of the Department of 23 Health and Welfare is hereby authorized to control program costs by lowering 24 or raising income eligibility criteria in order to stay within budget; but, 25 under no circumstance shall the department exceed one hundred fifty percent 26 (150%) of the federal poverty level that is used in determining eligibility 27 without prior legislative approval. 28 SECTION 7. The Idaho Legislature recognizes the work of the Children's 29 Health Insurance Program Task Force appointed by the director of the Depart- 30 ment of Health and Welfare. The department is encouraged to implement the rec- 31 ommendations of the task force to the extent legally possible and to apply for 32 the necessary federal waivers where required in order to provide basic health 33 care coverage for Idaho's uninsured children.

(1.8%) 13.6% (0.1%) 11.7% 11.7% The appropriation for Medical Assistance includes the base amount plus $14.1 million to provide a 2.5% increase to those providers whose reimbursement rates are not set in Idaho Code, $11.2 million to cover increased hospital and drug costs and to fund those providers whose reimbursements are set in Idaho Code, $223,600 to cover CEC, $2.2 million to increase dental reimbursement, and $1.2 million to adjust rates for developmental disability services. Also included in this appropriation is a fund shift of $11.4 million to General and Federal funding sources for continued program support. Section 5 directs the department to provide waivered services to those individuals who qualify for such services, and to utilize appropriate home and community-based services (HCBS) first before considering the placement of an individual in an intermediate care facility for the mentally retarded (ICF-MR). Section 6 caps General Funds for the Title XXI Children's Health Insurance Program at $4.2 million and caps eligibility at 150% of the federal poverty level.
