S1269|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1269 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO VIOLATIONS OF LAWS GOVERNING ALCOHOL BEVERAGES; AMENDING SECTION 3 23-603, IDAHO CODE, AS AMENDED BY SECTION 3, SENATE BILL 1123, AS ENACTED 4 BY THE FIRST REGULAR SESSION OF THE FIFTY-FIFTH IDAHO LEGISLATURE, TO PRO- 5 VIDE THAT A SECOND OR SUBSEQUENT OFFENSE SHALL CONSTITUTE A FELONY; AND 6 AMENDING CHAPTER 6, TITLE 23, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 7 23-604, IDAHO CODE, TO PROVIDE THAT PURCHASE, CONSUMPTION OR POSSESSION OF 8 AN ALCOHOL BEVERAGE BY A MINOR SHALL BE A MISDEMEANOR. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 23-603, Idaho Code, as amended by Section 3, Sen- 11 ate Bill 1123, as enacted by the First Regular Session of the Fifty-fifth 12 Idaho Legislature be, and the same is hereby amended to read as follows: 13 23-603. DISPENSING TO MINOR. Any person who shall sell, give, or furnish, 14 or cause to be sold, given, or furnished, alcohol beverage, including any dis- 15 tilled spirits, beer or wine, to a person under the age of twenty-one (21) 16 years shall be guilty of a misdemeanor. A second or subsequent violation 17 of this section by the same defendant shall constitute a felony. Upon 18 conviction of any person for a violation of the provisions of this section, 19 the court shall notify the director of the department of law enforcement. The 20 director shall review the circumstances of the conviction, and if the dispens- 21 ing took place at a licensed establishment or other retailer or distributor, 22 the director may take administrative action he considers appropriate against 23 the licensee or business including suspension of the license for not to exceed 24 six (6) months, a fine, or both such suspension and fine. 25 SECTION 2. That Chapter 6, Title 23, Idaho Code, be, and the same is 26 hereby amended by the addition thereto of a NEW SECTION , to be 27 known and designated as Section 23-604, Idaho Code, and to read as follows: 28 23-604. MINORS -- PURCHASE, CONSUMPTION OR POSSESSION PROHIBITED. Any 29 person under twenty-one (21) years of age who shall purchase, attempt to pur- 30 chase, or otherwise consume or possess any alcohol beverage, including any 31 distilled spirits, beer or wine, shall be guilty of a misdemeanor and shall be 32 punished according to the schedule set out in section 18-1502, Idaho Code.
