 1                                        AN ACT
 2    APPROPRIATING MONEYS TO THE SUPERINTENDENT OF PUBLIC INSTRUCTION/STATE DEPART-
 3        MENT OF EDUCATION FOR FISCAL YEAR 2000; LIMITING THE NUMBER  OF  FULL-TIME
 4        EQUIVALENT  POSITIONS;  EXPRESSING LEGISLATIVE INTENT WITH RESPECT TO CER-
 5        TAIN EXPENDITURES; REAPPROPRIATING A CERTAIN UNEXPENDED  AND  UNENCUMBERED
 6        BALANCE  OF  GENERAL  FUNDS; AND SETTING FORTH CONDITIONS FOR THE REAPPRO-
 7        PRIATION.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  There is hereby appropriated to the Superintendent  of  Public
10    Instruction/State  Department  of  Education  the  following  amounts,  to  be
11    expended according to the designated expense classes from the listed funds for
12    the period July 1, 1999, through June 30, 2000:

38        SECTION  2.  In  accordance  with  Section  67-3519, Idaho Code, the State
39    Department of Education is authorized no more  than  one  hundred  nine  (109)
40    full-time  equivalent  positions  at any point during the period July 1, 1999,
41    through June 30, 2000, unless specifically authorized  by  the  Governor.  The
42    Joint  Finance-Appropriations  Committee  will  be  notified  promptly  of any
43    increased positions so authorized.

 1        SECTION 3.  It is legislative intent that an amount, not to exceed  $1,000
 2    of  the General Fund moneys appropriated in Section 1 of this act, may be used
 3    at the discretion of the Superintendent of Public  Instruction  to  assist  in
 4    defraying expenses relating to or resulting from the discharge of his official
 5    duties.  Such  moneys  shall  be  accounted for according to the provisions of
 6    Chapter 36, Title 67, Idaho Code, and Section 67-3516, Idaho Code.

 7        SECTION 4.  There is hereby reappropriated to the Superintendent of Public
 8    Instruction/State Department of Education, subject to the provisions  of  Sec-
 9    tion  5  of  this  act, the unexpended and unencumbered balance of the General
10    Fund appropriation made by Section 1, Chapter 282, Laws of 1998,  to  be  used
11    for  nonrecurring  expenditures  for the period July 1, 1999, through June 30,
12    2000.

13        SECTION 5.  The reappropriation granted in Section 4 of this act shall  be
14    subject to the following provision:
15        (1)  If  the  unexpended  and  unencumbered balance in the General Fund on
16    June 30, 1999, is zero, the reappropriation in Section 4 of this act is hereby
17    declared to be null and void.
18        (2)  If the unexpended and unencumbered balance in  the  General  Fund  on
19    June  30,  1999, is greater than zero but less than the total General Fund re-
20    appropriation authority granted to all state agencies, the amount  reappropri-
21    ated in Section 4 of this act shall be in the proportion that the reappropria-
22    tion  for  the Superintendent of Public Instruction/State Department of Educa-
23    tion bears to the total General Fund reappropriation authority granted to  all
24    state agencies.
