                           SENATE CONCURRENT RESOLUTION NO. 104

                        BY COMMERCE AND HUMAN RESOURCES COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING THE REPEAL OF CERTAIN  RULES
 3        OF  THE  INDUSTRIAL  COMMISSION  RELATING  TO MINIMUM SAFETY STANDARDS AND
 4        PRACTICES FOR LOGGING.

 5    Be It Resolved by the Legislature of the State of Idaho:

 6        WHEREAS, the Legislature is vested  with  authority  to  reject  executive
 7    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
 8    that  the Legislature finds that the rules are not consistent with legislative
 9    intent; and
10        WHEREAS, it is the finding of the Legislature that certain  rules  of  the
11    Industrial Commission repealing rules relating to Minimum Safety Standards and
12    Practices for Logging are not consistent with legislative intent and should be
13    rejected.
14        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
15    of  the Fifty-fifth Idaho Legislature, the Senate and the House of Representa-
16    tives concurring therein, that the pending repeal by the Industrial Commission
17    of IDAPA 17.08.01 through and including IDAPA 17.08.16, rules  of  the  Indus-
18    trial  Commission  relating to Minimum Safety Standards and Practices for Log-
19    ging, adopted as pending rules under Docket Numbers 17-0801-9801  through  and
20    including  Docket Number 17-0816-9801, be, and the same is hereby rejected and
21    declared null, void and of no force and effect, and that  the  repeal  of  the
22    above rules hereby having been rejected, that the above rules relating to Min-
23    imum Safety Standards and Practices for Logging shall remain in full force and
24    effect  as  they are published and as they now appear in the Idaho Administra-
25    tive Code.
26        BE IT FURTHER RESOLVED that it is legislative intent that the above  rules
27    relating  to Minimum Safety Standards and Practices for Logging remain in full
28    force and effect and that the Industrial Commission not adopt any rules,  pro-
29    posed,  pending or temporary in nature, that in any way repeal or restrict the
30    operation of the  above  rules  without  specific  legislative  direction  and
31    authority.

Statement of Purpose / Fiscal Impact


                        STATEMENT OF PURPOSE

                              RS 08686

The State Industrial Commission has proposed a repeal of
administrative rules of the commission that provide for minimum
safety standards and practices for logging. This resolution would
reject the repeal of those rules and leave the current rules that
provide for minimum safety standards and practices for logging in
place. Further, the resolution would express legislative intent
that the Industrial Commission not repeal or restrict the operation
of those safety standards and practices without specific
legislative direction and authority.

                            FISCAL NOTE

This resolution would have no fiscal impact.
