SCR110|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 110 BY HEALTH AND WELFARE COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING LEGISLATIVE FINDINGS AND REQUESTING THE DEPARTMENT OF HEALTH AND WEL- 3 FARE TO FIELD TEST A PROGRAM FOR THE ELDERLY AND PHYSICALLY DISABLED. 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Governor's Medicaid Reform Advisory Council, created by Exec- 6 utive Order No. 96-08, found that persons needing long-term care including the 7 elderly and physically disabled, requested more options to meet their needs, 8 increased flexibility in services received, and to be able to stay in their 9 own homes as long as possible; 10 WHEREAS, one of the Governor's Medicaid Reform Initiatives directs the 11 Department of Health and Welfare to make necessary changes in law and rule to 12 create a system of long-term care for elderly and disabled adults that allows 13 for the provision of client or family-directed services and for the provision 14 of services in the most cost-effective, least restrictive setting possible; 15 WHEREAS, Idaho's population of persons age 85 or older averaged an annual 16 5.6 percent increase from 1990 to 1996; 17 WHEREAS, Idaho medicaid costs for nursing home care averaged an annual ten 18 percent increase from 1992 to 1996; 19 WHEREAS, the American Association of Retired Persons (AARP) found that 20 services provided in homes and communities cost less than institutional care; 21 WHEREAS, the Department of Health and Welfare was charged by the Governor 22 to coordinate with the Idaho Commission on Aging to develop a Home and 23 Community-Based Services waiver (HCBS) for Idaho citizens who are elderly or 24 physically disabled; 25 WHEREAS, the proposed HCBS waiver offers eligible individuals who are 26 elderly or physically disabled the choice of a comprehensive system of in-home 27 services and promotes self-sufficiency, independence, dignity, choice and pri- 28 vacy. 29 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 30 of the Fifty-fifth Idaho Legislature, the Senate and the House of Representa- 31 tives concurring therein, that the Department of Health and Welfare shall 32 field test the HCBS waiver for the elderly and physically disabled in the 33 selected geographic service area and phase-in implementation in other geo- 34 graphic service areas of the state following the field test. 35 BE IT FURTHER RESOLVED that the Department of Health and Welfare shall 36 adopt temporary rules as may be needed to carry out this resolution, and 37 review and propose any necessary amendments to state law and rule for an 38 effective use of resources and the provision of home and community-based ser- 39 vices.

Authorizes the Department of Health and Welfare to move forward
with the Governor's Medicaid Reform Initiative to field test home
and community-based services for the elderly and physically
disabled and to adopt temporary rules to carry out this
resolution.
FISCAL NOTE
There will be no impact on the General Fund.
