                           SENATE CONCURRENT RESOLUTION NO. 114

                                  BY EDUCATION COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
 3        APPOINT A COMMITTEE TO UNDERTAKE  AND  COMPLETE  A  STUDY  OF  IDAHO  LAWS
 4        REGARDING  TEACHER AND ADMINISTRATOR CONTRACT AND EVALUATION PROCESSES AND
 5        PREPARE LEGISLATION FOR MODIFICATIONS AND  IMPROVEMENTS  IN  THE  EXISTING
 6        SYSTEM.

 7    Be It Resolved by the Legislature of the State of Idaho:

 8        WHEREAS, several legislative proposals have been considered in recent leg-
 9    islative  sessions  to  address  continuing areas of conflict relating to con-
10    tracts and evaluations between  teachers  and  administrators  in  the  public
11    school system; and
12        WHEREAS,  it  is important to Idaho citizens, particularly to the students
13    enrolled in the public education system, that the system operate smoothly  and
14    efficiently; and
15        WHEREAS,  it  is  in  the best interests of all parties concerned that the
16    legislative framework established in the state law be a framework which facil-
17    itates cooperation and the most positive outcome; and
18        WHEREAS, legislators need to give concentrated  attention  to  appropriate
19    revisions to the existing law and make recommendations to the Legislature.
20        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
21    of  the Fifty-fifth Idaho Legislature, the Senate and the House of Representa-
22    tives concurring therein,  that  the  Legislative  Council  is  authorized  to
23    appoint  a committee to undertake and complete a study of Idaho laws regarding
24    teacher and administrator contract and evaluation processes and prepare legis-
25    lation for modifications and improvements in the existing system. The Legisla-
26    tive Council shall determine the number of  legislators  and  membership  from
27    each  house  appointed  to  the committee and shall authorize the committee to
28    receive input, advice and assistance from interested and affected parties  who
29    are not members of the Legislature.
30        BE IT FURTHER RESOLVED that nonlegislative members of the committee may be
31    appointed  by  the cochairs of the committee who are appointed by the Legisla-
32    tive Council. Nonlegislative members of the advisory committee  shall  not  be
33    reimbursed  from legislative funds for per diem, mileage or other expenses and
34    shall not have voting privileges regarding the committee's recommendations  or
35    proposed legislation.
36        BE  IT FURTHER RESOLVED that the committee shall report its findings, rec-
37    ommendations and proposed legislation, if any, to the Second  Regular  Session
38    of the Fifty-fifth Idaho Legislature.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                              RS09038

The current laws concerning evaluation of and contracts for
teachers and administrators are vague, ambiguous and are the source
of much litigation and unneccesary expenditure of taxpayers' money.
In recent years there have been various legislators as well as
individual personnel make attempts to resolve some of the issues
with little or no success. The establishment of this interim
committee will bring focus to the problem and with insight from
legislators who are not directly impacted by the proposed
legislation,resolution can be reached.




                            FISCAL NOTE
It is projected that it will cost $8000. Further it is projected
that significantly more than that could be saved in subsequent
years by the reduction in litigation costs.
