SUBSTANCE ABUSE - Stating findings of the Legislature and authorizing the
Legislative Council to appoint a committee to study the issues facing the
people of Idaho in addressing substance abuse, including a consideration

 2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
 3        APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF ISSUES FACING THE
 4        PEOPLE OF IDAHO IN ADDRESSING SUBSTANCE ABUSE  INCLUDING  A  CONSIDERATION
 5        AND  EVALUATION  OF  EDUCATION PROGRAMS, PREVENTION PROGRAMS AND TREATMENT
 6        ALTERNATIVES WITH A GOAL OF MAKING  RECOMMENDATIONS  CONCERNING  THE  MOST
 7        EFFICACIOUS USE OF STATE FUNDS TO ACHIEVE THE DESIRED OUTCOME.

 8    Be It Resolved by the Legislature of the State of Idaho:

 9        WHEREAS,  the  Legislative  Council  Interim Committee on Alcohol Laws has
10    recommended that a committee evaluate the effectiveness and adequacy of  state
11    and local programs and actions dealing with substance abuse education and pre-
12    vention  and  recommend  an  appropriate  program structure to deal with those
13    issues and the estimated cost of such programs and treatment programs; and
14        WHEREAS, the Chief Justice of the Idaho  Supreme  Court  has  stated  that
15    alcohol  and  drug  abuse is the largest problem facing the courts, if not the
16    whole society; and
17        WHEREAS, programs are recognized as the most responsible approach to  sub-
18    stance abuse and are strongly endorsed and supported; and
19        WHEREAS,  a major complication in achieving the most effective use of pub-
20    lic assets is the existence of a plethora  of  commendable  but  uncoordinated
21    programs  in  various  agencies and many levels of government and this problem
22    was highlighted in Governor Batt's November 1998  report  on  substance  abuse
23    programs in Idaho.
24        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
25    of  the Fifty-fifth Idaho Legislature, the Senate and the House of Representa-
26    tives concurring therein,  that  the  Legislative  Council  is  authorized  to
27    appoint a committee of not more than eight members to undertake and complete a
28    study  of issues facing the people of Idaho in addressing substance abuse. The
29    study should consider and evaluate education programs, prevention programs and
30    treatment alternatives with a goal of making  recommendations  concerning  the
31    most  efficacious  use  of  state  funds to achieve the desired outcome and an
32    estimate of annual costs to implement and operate such programs. The  Legisla-
33    tive  Council  shall  determine  the  number  of  legislators  from each house
34    appointed to the committee and shall authorize the committee to hold hearings,
35    receive input, advice and assistance from interested and affected parties  who
36    are not members of the legislature.
37        BE  IT FURTHER RESOLVED that the committee shall report its findings, rec-
38    ommendations and proposed legislation, if any, to the Second  Regular  Session
39    of the Fifty-fifth Idaho Legislature.

Statement of Purpose / Fiscal Impact


                         STATEMENT OF PURPOSE

                               RS 09067

This legislation authorizes Legislative Council to form an "Interim
Committee on Substance Abuse Issues" as recommended by the Interim
Committee on Alcohol and Beverage 1aws (the 1998 Committee).

The 1998 Committee found that the societal problems resulting
from substance abuse are a major concern and problem to the
citizens of Idaho and need to be addressed in a comprehensive
manner. For example:
1. The Association of Idaho Cities has undertaken a statewide
"Enough is Enough" campaign wherein every Idaho city has signed a
pledge to fight and stop the scourge of substance abuse in our
society.
2. Idaho Supreme Court Justice, Linda Copple Trout, stated that
"The judges are single minded in their perception that drug and
alcohol addiction is the largest problem facing the courts, if
not the whole society".
3. In November 1998, Governor Batt issued his report on the
methods Idaho uses to deal with those who abuse alcohol and drugs
and found our state and local systems to be incomplete, under
funded, uncoordinated and not having adequate performance and
accountability standards and measures.
4. Over 90% of juveniles and adults in prison or on parole
suffer from some form of chemical substance addiction.

The 1998 Committee recommends that the "Interim Committee on
                                                                Substance Abuse Issues" develop a complete, seamless, coordinated
system of education, prevention and treatment of drug and alcohol
abuse within and between state and local governments.

The Committee's study should include evaluation of issues such as
the type of education needed, early/prompt intervention, detox
options, judicial alternatives, treatment in prison and while on
parole, half-way houses, etc. The Committee should develop a
conceptual design for performance, accountability and reporting
standards/measures, estimated cost net of present funding sources
and implementation time line.
