SJM102|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE JOINT MEMORIAL NO. 102 BY STATE AFFAIRS COMMITTEE 1 A JOINT MEMORIAL 2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS 3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF 4 IDAHO IN THE CONGRESS OF THE UNITED STATES. 5 We, your Memorialists, the Senate and the House of Representatives of the 6 State of Idaho assembled in the First Regular Session of the Fifty-fifth Idaho 7 Legislature, do hereby respectfully represent that: 8 WHEREAS, the federal administration under President Clinton is continually 9 usurping the powers reserved for the Congress of the United States; and 10 WHEREAS, the Clinton administration is, by administrative decree, making 11 law and thereby bypassing both the advise and consent of the Congress; and 12 WHEREAS, these administrative laws are being thrust upon the citizens of 13 Idaho and such laws are vigorously enforced by administration bureaucrats. 14 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 15 of the Fifty-fifth Idaho Legislature, the Senate and the House of Representa- 16 tives concurring therein, that we hereby urgently and earnestly appeal to the 17 Congress of the United States to reclaim its constitutional authority and 18 responsibility to be the law-making body of these United States of America. 19 BE IT FURTHER RESOLVED that we respectfully request the Congress to imple- 20 ment procedures similar to the procedure employed by the state of Idaho which 21 requires all rules proposed by executive agencies to be submitted to the Leg- 22 islature of the State of Idaho for final approval before such administrative 23 law may become effective. 24 BE IF FURTHER RESOLVED that we urge the Congress to limit the scope of 25 executive orders by subjecting such orders to congressional approval before 26 they may become effective. 27 BE IT FURTHER RESOLVED that the Secretary of the Senate be, and she is 28 hereby authorized and directed to forward a copy of this Memorial to the Pres- 29 ident of the Senate and the Speaker of the House of Representatives of Con- 30 gress, and to the congressional delegation representing the State of Idaho in 31 the Congress of the United States.
