                             SENATE JOINT RESOLUTION NO. 101

                                BY STATE AFFAIRS COMMITTEE

 1                                  A JOINT RESOLUTION
 2    PROPOSING AN AMENDMENT TO SECTION 3, ARTICLE III, OF THE CONSTITUTION  OF  THE
 3        STATE  OF  IDAHO,  RELATING TO TERMS OF OFFICE OF STATE SENATORS AND STATE
 4        REPRESENTATIVES, BY INCREASING THE TERM OF OFFICE FROM TWO YEARS  TO  FOUR
 5        YEARS  STARTING  IN  2002, AND PROVIDING FOR THE ELECTION OF APPROXIMATELY
 6        ONE-HALF OF THE SENATORS AND REPRESENTATIVES AT  EACH  BIENNIAL  ELECTION;
 7        STATING THE QUESTION TO BE SUBMITTED TO THE ELECTORATE; DIRECTING THE LEG-
 8        ISLATIVE  COUNCIL TO PREPARE THE STATEMENTS REQUIRED BY LAW; AND DIRECTING
 9        THE SECRETARY OF STATE TO PUBLISH THE AMENDMENT AND ARGUMENTS AS  REQUIRED
10        BY LAW.

11    Be It Resolved by the Legislature of the State of Idaho:

12        SECTION  1.  That Section 3, Article III, of the Constitution of the State
13    of Idaho be amended to read as follows:

14             SECTION  3.  TERM  OF  OFFICE.    Commencing  in  2002,   t
15          T  he senators and representatives  from odd-
16        numbered districts  shall be elected for the term of two  
17        (2)   years,  and commencing in 2004, shall be elected for
18        the term of four years,  from and after the first day of Decem-
19        ber next following the general  election  ;  and  commencing  in
20        2002,  the  senators and representatives from even-numbered districts
21        shall be elected for the term of four years, from and after the first
22        day of December next following the general election .

23        SECTION 2.  The question to be submitted to the electors of the  State  of
24    Idaho at the next general election shall be as follows:
25        "Shall  Section  3, Article III, of the Constitution of the State of Idaho
26    be amended to provide four-year terms for state senators and state representa-
27    tives starting in 2002, and to provide for the election of approximately  one-
28    half of the senators and representatives at each biennial election?".

29        SECTION  3.  The Legislative Council is directed to prepare the statements
30    required by Section 67-453, Idaho Code, and file the same.

31        SECTION 4.  The Secretary of State is hereby directed to publish this pro-
32    posed constitutional amendment and arguments as required by law.
