 1                                        AN ACT
 2    RELATING TO THE DIVISION OF BUILDING SAFETY; AMENDING SECTION  54-1009,  IDAHO
 3        CODE,  TO  PROVIDE CORRECT REFERENCES TO THE ADMINISTRATOR OF THE DIVISION
 4        AND TO MAKE TECHNICAL CORRECTIONS.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 54-1009, Idaho Code, be, and the same  is  hereby
 7    amended to read as follows:

 8        54-1009.  REVOCATION  OR SUSPENSION OF LICENSES -- HEARINGS -- TAKING TES-
 9    TIMONY. The  director   administrator  shall have  power
10    to  revoke  or  suspend  any license if the same was obtained through error or
11    fraud, or if the holder thereof is shown to be  grossly  incompetent,  or  has
12      wilfully     willfully  violated any of the rules pre-
13    scribed by the board, or as prescribed in this act; or has, after due  notice,
14    failed  or  refused  to  correct,  within  the  specified time, any electrical
15    installation not in compliance with the  provisions  of  this  act,  provided,
16    before  any  license  shall  be revoked or suspended, the holder thereof shall
17    have written notice enumerating the charges against him, and shall be given  a
18    hearing  by said  director   administrator , and have an
19    opportunity to produce testimony in his behalf, at a time and place  specified
20    in said notice, which time shall not be less than five (5) days after the ser-
21    vice thereof .  The proceedings shall be governed by the provisions
22    of  chapter 52, title 67, Idaho Code. Any party aggrieved by the action of the
23     director   administrator  shall be entitled to judicial
24    review thereof in accordance with the provisions  of  chapter  52,  title  67,
25    Idaho Code.
26        The   director   administrator  shall have the power
27    to appoint, by an order in writing, a hearing officer to take  testimony,  who
28    shall  have  power  to administer oaths, issue subpoenas and compel the atten-
29    dance of witnesses, and the decision of the  director   admin-
30    istrator  shall be based on his examination of the testimony  taken  and
31    the records produced. Any person whose license has been revoked may, after the
32    expiration  of  one (1) year from the date of such revocation, but not before,
33    apply for a new license.

                      STATEMENT  OF  PURPOSE
                             RS08354
Replace "director" with "administrator" in Idaho Code 54-1009. 
This section was not updated when the 1996 Idaho Legislature
reorganized the agencies of the Department of Labor and Industrial
Services.  The "director" of the Department of Labor and Industrial
Services was changed to the "administrator" of the Division of
Building Safety in all sections of title 54, chapter 10 where it
appeared except section 54-1009.
