H0116|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 116 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO ELECTIONS; AMENDING SECTION 34-702A, IDAHO CODE, TO INCREASE THE 3 WRITE-IN CANDIDATE FILING DEADLINE FOR A PRIMARY OR GENERAL ELECTION TO 4 TWENTY-FIVE DAYS BEFORE SUCH ELECTION. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 34-702A, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 34-702A. DECLARATION OF INTENT FOR WRITE-IN CANDIDATES. No write-in vote 9 for any office in a primary, special, or general election shall be counted 10 unless a declaration of intent has been filed indicating that the person 11 desires the office and is legally qualified to assume the duties of said 12 office if elected. The declaration of intent shall be filed with the secretary 13 of state if for a federal, state, or legislative district office and with the 14 county clerk if for a county office. Such declaration of intent shall be filed 15 not later thaneleventwenty-five (111625 ) days before the day of election. The secretary of state 17 shall prescribe the form for said declaration.
STATEMENT OF PURPOSE RS 08653 The purpose of this bill is to establish a twenty-five (25) day deadline for all write-in candidates to file prior to an election. Currently the time frame for write-in candidates in non-partisan elections is twenty-five (25) days prior to the election and this will provide uniformity. The current period of eleven (11) days for partisan write-in candidates is too short of a time span to make final preparations especially for counties using an optical scan voting system. FISCAL IMPACT No fiscal impact on the state general fund or any of its political subdivisions.
