members of the Commission on Arts and Humanities who are appointed after

                                    HOUSE BILL NO. 133

                                BY STATE AFFAIRS COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE COMMISSION ON ARTS AND HUMANITIES; AMENDING  SECTION  67-5603,
 3        IDAHO  CODE,  TO  PROVIDE  THAT  MEMBERS OF THE COMMISSION APPOINTED AFTER
 4        JUNE, 1991, MAY BE APPOINTED FOR A TERM  OF  LESS  THAN  FOUR  YEARS;  AND
 5        DECLARING AN EMERGENCY.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Section 67-5603, Idaho Code, be, and the same is hereby
 8    amended to read as follows:

 9        67-5603.  TERMS OF MEMBERS -- APPOINTMENT OF OFFICERS -- SERVICE  OF  MEM-
10    BERS  --  COMPENSATION.  The  term  of office of each member shall be four (4)
11    years; provided, however that of the members appointed during or  after  
12    March     June , 1991, the governor may appoint for a term of
13    less than four (4) years so that not more than four (4) terms  expire  in  any
14    one (1) year. The governor shall designate a chairman and a vice-chairman from
15    the  members  of the commission to serve as such at the pleasure of the gover-
16    nor. All vacancies shall be filled for the balance of the  unexpired  term  in
17    the  same manner as original appointments. The members of the commission shall
18    be compensated as provided by section 59-509(b), Idaho Code.

19        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
20    declared to exist, this act shall be in full force and effect on and after its
21    passage and approval.

Statement of Purpose / Fiscal Impact


                         STATEMENT OF PURPOSE
                                RS08645

This will change the appointment date for Commissioners serving on the
Commission on the Arts and Humanities from March to June. This allows
the Governor more time to make the appointments to this Commission.

In the past, new appointments were often not completed by the late
spring meeting date as needed.
