2 RELATING TO MOTOR VEHICLES; AMENDING CHAPTER 6, TITLE 49, IDAHO CODE, BY THE
3 ADDITION OF A NEW SECTION 49-658, IDAHO CODE, TO PROHIBIT SPEEDING IN
4 POSTED SCHOOL ZONES AND RESIDENTIAL NEIGHBORHOODS, TO PROVIDE PENALTIES,
5 TO PROVIDE THAT LOCAL UNITS OF GOVERNMENT MAY APPLY THIS SECTION BY RESO-
6 LUTION AND TO REQUIRE SIGNS STATING THAT INCREASED PENALTIES APPLY.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Chapter 6, Title 49, Idaho Code, be, and the same is
9 hereby amended by the addition thereto of a NEW SECTION , to be
10 known and designated as Section 49-658, Idaho Code, and to read as follows:
11 49-658. SPEEDING IN SCHOOL ZONES AND RESIDENTIAL NEIGHBORHOODS -- PENAL-
12 TIES. (1) No person shall operate a vehicle in excess of the maximum posted
13 speed limit established for a posted school zone or a residential neighbor-
15 (2) Violation of this section shall be an infraction punishable by penal-
16 ties provided in rule 9 of the Idaho infraction rules. The penalties provided
17 by the rules shall be doubled for violations between eleven (11) and twenty
18 (20) miles per hour over the maximum posted speed limit, and shall double
19 again for every additional ten (10) miles an hour over the maximum posted
20 speed limit.
21 (3) Local units of government with authority to establish and designate
22 school zones and residential neighborhoods have the option to apply this sec-
23 tion, by resolution stating application, within designated school zones and
24 residential neighborhoods. Application and enforcement is contingent upon the
25 erection of adequate signs indicating that increased penalties will apply to
26 violations of the maximum posted speed limit in the school zone or residential
STATEMENT OF PURPOSE
The purpose of this legislation is to enable local units of
government, with authority to establish school zones and
residential neighborhoods, to increase the penalty charges for
exceeding the posted speed limit in these school zones and
residential neighborhoods. This penalty increase can be
implemented by adoption of a resolution by the governing body
identifying the boundaries of affected area.
There is no fiscal impact at the state level. There is a possible
positive affect in local areas implementing these provisions.
