H0160|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 160 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO MILITARY AFFAIRS; AMENDING SECTION 46-714, IDAHO CODE, TO PROVIDE 3 THAT NO CONTRACT IN EXCESS OF THE THRESHOLD AMOUNT SPECIFIED FOR THE 4 REQUIREMENT FOR FORMAL BIDS MAY BE LET BY THE ADJUTANT GENERAL UNTIL WRIT- 5 TEN APPROVAL IS GIVEN BY THE BOARD OF EXAMINERS. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 46-714, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 46-714. APPROVAL OF BOARD OF EXAMINERS. No contract in excess of 10 the threshold amount specified for the requirement for formal bids in section 11 67-5711, Idaho Code, may be let by the adjutant general until written 12 approval of the same shall be given by the board of examiners.
STATEMENT OF PURPOSE RS08394 This proposal amends Idaho Code Section 46-714 to enable the Military Division to let contracts for minor armory construction and repair that are under the statutory threshold for informal bids set out in Idaho Code Section 67-5711, without requiring the approval of the Board of Examiners on such small contracts. This will eliminate the need to obtain the approval and signatures of the board of examiners on small contracts, such as armory roof repair, that are for less than the formal bidding threshold for other state agencies, currently $30,000. FISCAL IMPACT This proposal will, if adopted, save the state the additional administrative costs and overhead now expended in obtaining the approval and signatures of all members of the Board of Examiners for all armory repair contracts under $30,000. That sum is difficult to determine, but it can be substantial, especially if one counts the costs incurred by the Attorney General to perform a legal review prior to his approval and signature on all Military Division contracts under $30,000, as is done now.
