H0162|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 162 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO CONSTRUCTION, EXPANSION AND REHABILITATION OF ARMORIES; AMENDING 3 SECTION 46-713, IDAHO CODE, TO PROVIDE A CORRECT STATUTORY CITATION, TO 4 PROVIDE THAT THE ADJUTANT GENERAL IS EMPOWERED TO EXERCISE THE AUTHORITIES 5 FOR EMERGENCY CONTRACTING WITH RESPECT TO EMERGENCIES FOR ARMORIES AND TO 6 MAKE A TECHNICAL CORRECTION. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 46-713, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 46-713. CONSTRUCTION, EXPANSION AND REHABILITATION OF ARMORIES -- SUPER- 11 VISION BY ADJUTANT GENERAL. The adjutant general is authorized and empowered 12 to provide or secure all plans and specifications for, to let all contracts 13 for, and to have charge of and supervision of the construction, expansion, 14 rehabilitation or conversion of any and all armories as provided in this act, 15 and the powers and duties vested in the adjutant general herein are expressly 16 exempted from the provisions of sections 57-1101--through 17 57-1107, and section67-230467-5711, Idaho 18 Code. The adjutant general is also empowered to exercise the authorities 19 set out in section 67-5711B, Idaho Code, with respect to emergencies for 20 armories.
STATEMENT OF PURPOSE RS08430 This proposal amends Idaho Code Section 46-713 to enable the Adjutant General to exercise the authority set out in Idaho Code Section 67-5711B to permit emergency contracting (with limited competition and waiver of plans and specifications) when he finds that the emergency conditions set out therein exist for contracts within the military division's contracting authority. This will permit the Military Division to enter into emergency contracts under the same conditions that enable the Dept. of Administration to now waive certain contracting requirements in an emergency. This authority does not now extend to the Military Division's contracting authority and prevents the use of this authority for Military Division emergencies. This change will fix that problem. FISCAL IMPACT This proposal will enable the Military Division to expedite contacting actions during emergencies and save the additional costs incurred in processing the more comprehensive contracting actions as they must do now without this emergency authority. Failure to provide this authority could also increase the cost of agency operations when the failure to provide timely goods and services during an emergency results in the loss of state property or increases the costs incurred in responding to the emergency due to the additional delay in contract processing time. While it is difficult to estimate the size of this cost, since it is dependent upon each emergency, it could result in substantial cost savings to the state. CONTACT Name: Lt. Col. Blair D.
