                            BY REVENUE AND TAXATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO PAYMENT OF TAXES TO THE STATE TAX COMMISSION BY  CREDIT  CARD  AND
 3        OTHER  COMMERCIALLY  ACCEPTABLE MEANS; AMENDING CHAPTER 1, TITLE 63, IDAHO
 4        CODE, BY THE ADDITION OF A NEW SECTION 63-117, IDAHO  CODE,  TO  AUTHORIZE
 5        THE  STATE TAX COMMISSION TO ACCEPT PAYMENT BY CREDIT CARD, TO PROVIDE FOR
 6        PAYMENT OF FEES FROM THE PROCEEDS OF SUCH PAYMENT AND TO PROVIDE AN APPRO-
 7        PRIATION FOR SUCH PAYMENT.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  That Chapter 1, Title 63, Idaho Code,  be,  and  the  same  is
10    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
11    known and designated as Section 63-117, Idaho Code, and to read as follows:

12        63-117.  PAYMENT OF TAXES BY CREDIT CARD AND OTHER COMMERCIALLY ACCEPTABLE
13    MEANS. (1) The state tax commission, in cooperation with the state  treasurer,
14    may accept payment by credit card, debit card or other commercially acceptable
15    means  from any person making any payment to the state tax commission of taxes
16    or other amounts due under any law administered by the commission. If the pay-
17    ment is made by credit card, debit card, charge card, or similar  method,  the
18    liability  is not finally discharged and the person has not paid the tax until
19    the department receives payment or credit from the institution responsible for
20    making the payment or credit. Upon receipt, the amount shall be deemed paid on
21    the date the charge was made.
22        (2)  The commission may pay, through discount or otherwise, any fee  to  a
23    financial  institution  or  credit card company for a payment made pursuant to
24    this section from the proceeds of the taxes or other amounts paid prior to any
25    other distribution of the proceeds required by law. The necessary  portion  of
26    the  proceeds collected under this section is hereby appropriated for the pur-
27    pose of paying the fee.

                       STATEMENT OF PURPOSE

This bill allows the State Tax Commission, in cooperation with
the State Treasurer, to accept payment by credit card, debit card
or other commercially acceptable means, to provide for payment of
fees from the proceeds of such payment and providing an
appropriation for the payment.











                           FISCAL NOTE

No net fiscal effect. Increased collections are expected to
offset the administrative costs of providing the service to
taxpayers.
