 1                                        AN ACT
 2    RELATING TO SPECIAL LICENSE PLATES; AMENDING CHAPTER 4, TITLE 49, IDAHO  CODE,
 3        BY  THE  ADDITION OF A NEW SECTION 49-418B, IDAHO CODE, TO AUTHORIZE ISSU-
 4        ANCE OF AN IDAHO YOUTH LICENSE  PLATE  AND  TO  DESIGNATE  DISPOSITION  OF
 5        RECEIPTS FROM THE PLATE; AND PROVIDING AN EFFECTIVE DATE.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Chapter  4,  Title  49, Idaho Code, be, and the same is
 8    hereby amended by the addition thereto of a  NEW SECTION  ,  to  be
 9    known and designated as Section 49-418B, Idaho Code, and to read as follows:

10        49-418B.  IDAHO  YOUTH PLATES. (1) On or after January 1, 2000, any person
11    who is the owner of a vehicle  registered  under  the  provisions  of  section
12    49-402, Idaho Code, or registered under any other section of law for which the
13    purchase  of  special  plates  is  allowed,  may apply for and upon department
14    approval receive special Idaho youth license plates in lieu of regular license
15    plates. Availability of Idaho youth plates for other vehicles shall be subject
16    to the rules, policies and procedures of the department.
17        (2)  In addition to the regular registration fee required  in  chapter  4,
18    title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol-
19    lars  ($35.00) for the initial issuance of the plates, and twenty-five dollars
20    ($25.00)  upon  each  succeeding  annual  registration.  Twenty-five   dollars
21    ($25.00)  of  the  initial fee and fifteen dollars ($15.00) of the renewal fee
22    shall be deposited in the state highway account and shall be used to fund  the
23    cost  of the administration of this special license plate program. Ten dollars
24    ($10.00) of each initial fee and ten dollars  ($10.00)  of  each  renewal  fee
25    shall be transferred by the county assessor's motor vehicle registration divi-
26    sion  of  each  county  into  the  youth  programs fund of the sheriff of that
27    county, for use in implementation of prevention and  early  intervention  pro-
28    grams  for  Idaho's at-risk youth including, but not limited to: (a) providing
29    mentoring programs, (b) creating safe places and structured activities in non-
30    school hours, (c) fostering good health, (d)  developing  effective  education
31    opportunities  for  marketable career skills, and (e) providing an opportunity
32    for youth to give back to their community.
33        (3)  Whenever title or interest in a vehicle registered under  the  provi-
34    sions  of  this section is transferred or assigned, the owner may transfer the
35    special plates to another vehicle upon payment of the required transfer  fees.
36    The  owner  may only display the plates on another vehicle upon receipt of the
37    new registration from the department.
38        (4)  The Idaho youth license plate shall be of a color and design compara-
39    ble to the standard issue of license plates with blue numerals on a red, white
40    and blue background, except that the word "Idaho" shall appear on  each  plate
41    and  the  county  designator  shall  be  omitted to provide for distinguishing
42    designs and slogans, acceptable to the Idaho association of  counties,  to  be
43    added  to  the plate. The design shall be approved by the department and shall

 1    utilize a numbering system as determined by the department. Initial  costs  of
 2    the plate program, including costs of plate design, shall be paid by the Idaho
 3    association of counties.
 4        (5)  Sample  Idaho  youth  license  plates  may  be purchased for a fee of
 5    thirty dollars ($30.00), twelve dollars ($12.00) of which shall  be  deposited
 6    in  the  state highway account and eighteen dollars ($18.00) of which shall be
 7    deposited in the sheriff's youth program fund of the county  where  the  plate
 8    was  purchased for the implementation of youth programs  for at-risk youth. No
 9    additional fee shall be charged for personalizing sample plates.

10        SECTION 2.  This act shall be in full force and effect on and after  Janu-
11    ary 1, 2000.

                       STATEMENT OF PURPOSE

 The purpose of this legislation is to amend Chapter 4, Title 49
by adding a new Section, Section 49-418B, to authorize the
Department of Transportation to issue an Idaho Youth License
Plate. The cost of the plate will be $35.00 for the initial
issuance, and $25.00 for each succeeding annual registration.
These fees are in addition to the regular registration fees.
When issued, $25.00 of the initial fee and $15.00 of the renewal
fees will be deposited in the state highway account to
administer the program. The remaining $10.00 of the initial fee
and renewal fee shall be transferred into the youth programs of
the sheriff of each county for the use in implementation of
prevention and early intervention programs for Idaho's at-risk
youth.

                            FISCAL NOTE
                                 
There will be no impact to the General Fund.
