H0280|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 280 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO CAMPAIGN FINANCE; AMENDING CHAPTER 66, TITLE 67, IDAHO CODE, BY 3 THE ADDITION OF A NEW SECTION 67-6607A, IDAHO CODE, TO PROHIBIT ACCEPTING 4 CERTAIN CAMPAIGN CONTRIBUTIONS, TO PROVIDE AN EXCEPTION AND TO PROVIDE 5 PENALTIES; AND DECLARING AN EMERGENCY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 66, Title 67, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION , to be 9 known and designated as Section 67-6607A, Idaho Code, and to read as follows: 10 67-6607A. PROHIBITION ON ACCEPTING CERTAIN CONTRIBUTIONS. No member of 11 the Idaho legislature, nor any political treasurer working on his or her 12 behalf, shall accept any contribution or pledge of a contribution on behalf of 13 that member's political committee during any regular or special session of the 14 legislature. If, during a regular or special session of the legislature, a 15 political treasurer files on behalf of the candidacy of any person for the 16 office of which a member of the legislature is the incumbent, the prohibitions 17 of this section no longer apply to that incumbent. 18 A violation of the provisions of this section shall be punishable by a 19 civil penalty of a fine of fifty dollars ($50.00) per occurrence and the con- 20 tribution received in violation of this section shall be forfeited to the gen- 21 eral fund. No other penalties pursuant to this chapter shall apply. 22 SECTION 2. An emergency existing therefor, which emergency is hereby 23 declared to exist, this act shall be in full force and effect on and after its 24 passage and approval.
STATEMENT OF PURPOSE RS0947C1 This legislation prohibits members of the legislature from accepting campaign contributions or pledges during a legislative session. It imposes a civil penalty of $50.00 per violation. FISCAL NOTE There would be a very small positive fiscal impact to the state if violations occurred.
