HCR015|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 15 BY BUSINESS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DEPART- 3 MENT OF FINANCE RELATING TO THE IDAHO RESIDENTIAL MORTGAGE PRACTICES ACT. 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Legislature is vested with authority to reject executive 6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 7 that the Legislature finds that the rules are not consistent with legislative 8 intent; and 9 WHEREAS, it is the finding of the Legislature that certain rules of the 10 Department of Finance relating to the Idaho Residential Mortgage Practices Act 11 are not consistent with legislative intent and should be rejected. 12 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 13 of the Fifty-fifth Idaho Legislature, the House of Representatives and the 14 Senate concurring therein, that IDAPA 12.01.10, the entire chapter, including 15 all sections and subsections therein, rules of the Department of Finance 16 relating to the Idaho Residential Mortgage Practices Act, adopted as a pending 17 rule under Docket Number 12-0110-9801, be, and the same is hereby rejected and 18 declared null, void and of no force and effect.
STATEMENT OF PURPOSE RS 08872 This concurrent resolution would reject certain pending rules of the Department of Finance relating to the Idaho Residential Mortgage Practices Act. The effect of this resolution, if adopted by both houses, would be to prevent those agency rules from going into effect. FISCAL NOTE This resolution has no fiscal impact. Contact: Rep. W.O.
