HCR019|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 19 BY WAYS AND MEANS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO 3 APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF THE CONSTRUCTION 4 INDUSTRY TO CONSIDER THE CONSOLIDATION OF GOVERNMENT AGENCIES FOR THE 5 EFFICIENT MANAGEMENT OF LAWS AND RULES WHICH GOVERN THE LICENSING AND 6 OPERATIONS OF THE CONSTRUCTION INDUSTRY, AND TO REVIEW LAWS REGULATING 7 THE CONSTRUCTION INDUSTRY FOR SUFFICIENCY AND RELATION TO CURRENT PRAC- 8 TICES. 9 Be It Resolved by the Legislature of the State of Idaho: 10 WHEREAS, the construction industry in Idaho is second only to agriculture 11 as a prime contributor to the economy; and 12 WHEREAS, it is important to recognize that primary subcontractors contrib- 13 ute more than fifty percent to building projects; and 14 WHEREAS, these subcontractors should be afforded reasonable legislative 15 protection as to risk and investment; and 16 WHEREAS, the state public works contractors licensing board does not have 17 the staff available to adequately investigate applications and verify finan- 18 cial status of applicants for licensure or for upgrade of licenses; and 19 WHEREAS, members of the industry are currently required to deal with mul- 20 tiple and separate government agencies in order to conduct their business; and 21 WHEREAS, a central location for members of the industry to conduct busi- 22 ness with the various government agencies would save time and money; and 23 WHEREAS, a central location would allow for better control of out-of-state 24 contractors and enable the collection of taxes due to Idaho from such contrac- 25 tors; and 26 WHEREAS, in the interest of efficiency and economy and to ensure coopera- 27 tive decisions, the rules and laws of the division of building safety, the 28 department of public works, the state public works contractors licensing 29 board, and enforcement of the national energy code (ASHFE-90-1), should be 30 managed by a central administration; and 31 WHEREAS, legislation relating to the industry should be updated to current 32 construction methods, public works licensing procedures and financial con- 33 tracts, and relationships between contractor and subcontractor should be clar- 34 ified. 35 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 36 of the Fifty-fifth Idaho Legislature, the House of Representatives and the 37 Senate concurring therein, that the Legislative Council is authorized and 38 directed to appoint an interim committee to undertake and complete a study of 39 the construction industry to consider the consolidation of government agencies 40 for the efficient management of laws and rules which govern the licensing and 41 operations of the construction industry, and to review laws regulating the 42 construction industry for sufficiency and relation to current practices. 43 BE IT FURTHER RESOLVED that nonlegislative members of the committee may be 44 appointed by the cochairs of the committee who are appointed by the Legisla- 2 1 tive Council. Nonlegislative members of the advisory committee shall not be 2 reimbursed from legislative funds for per diem, mileage or other expenses and 3 shall not have voting privileges regarding the committee's recommendations or 4 proposed legislation. 5 BE IT FURTHER RESOLVED that the committee shall report its findings, rec- 6 ommendations and proposed legislation, if any, to the Second Regular Session 7 of the Fifty-fifth Idaho Legislature.

This legislation requests the Legislative Council to appoint an interim
committee to undertake and complete a study of the construction industry to
consider the consolidation of government agencies for the efficient management
of laws and rules which govern the licensing and operations of the
construction industry, and to review laws regulating the construction industry
for sufficiency and relation to current practices.
FISCAL NOTE
The anticipated cost of a one-year study would be $11,000.00
