S1006|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1006 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO MOTOR VEHICLE ACCIDENTS; AMENDING SECTION 49-1303, IDAHO CODE, TO 3 PROVIDE THAT THE DRIVER OF A VEHICLE COLLIDING WITH AN UNATTENDED VEHICLE 4 SHALL LEAVE IDENTIFYING INFORMATION IN OR ON THE VEHICLE STRUCK IF THE 5 OWNER OR OPERATOR OF THE VEHICLE CANNOT BE LOCATED. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 49-1303, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 49-1303. DUTY UPON STRIKING UNATTENDED VEHICLE. The driver of any vehicle 10 which collides with any unattended vehicle shall immediately stop, and then 11 and there either locate and notify the operator or owner of the vehicle of the 12 name and address of the driver and owner of the vehicle striking the unat- 13 tended vehicle, or shall leave in a conspicuous place in or on 14 the vehicle struck a written notice giving the name and address of the driver 15 and of the owner of the vehicle doing the striking, along with a statement of 16 the circumstances.
STATEMENT OF PURPOSE RS 08534 This bill is one of a series of bills that the Justices of the Supreme Court transmitted to the Governor in their annual "defects in the law" report under Art. 5, Sec. 25 of the Idaho Constitution Idaho Code 49-1303 requires a driver of a motor vehicle which collides with an unattended vehicle to stop and locate the owner or leave certain information identifying the driver and describing the circumstances of the accident. However, this statute presently requires that this information must be left in a conspicuous place in the unattended vehicle which requires an impossibility if the unattended vehicle is locked. This bill amends I.C. 49-1303 to provide that the required information must be left in a conspicuous place either in or on the unattended vehicle. FISCAL NOTE This bill will not have an impact on state or local funds.
