                                   SENATE BILL NO. 1042

                             BY JUDICIARY AND RULES COMMITTEE

 1                                        AN ACT
 2    RELATING TO BOMBS; AMENDING CHAPTER 33, TITLE 18, IDAHO CODE, BY THE  ADDITION
 3        OF A NEW SECTION 18-3320A, IDAHO CODE, TO PROVIDE FOR DISPOSAL OF DESTRUC-
 4        TIVE DEVICES OR BOMBS, TO REQUIRE THAT CERTAIN RECORDS BE KEPT AND TO PRO-
 5        VIDE  THAT DESTRUCTION OF A DESTRUCTIVE DEVICE OR BOMB DOES NOT BAR PROSE-
 6        CUTION FOR ANY VIOLATION OF LAW.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION 1.  That Chapter 33, Title 18, Idaho Code, be,  and  the  same  is
 9    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
10    known and designated as Section 18-3320A, Idaho Code, and to read as follows:

11        18-3320A.  DISPOSAL OF  DESTRUCTIVE  DEVICES  OR  BOMBS.  Any  destructive
12    device  or  bomb that has been lawfully seized by a law enforcement agency may
13    be destroyed in a reasonable manner. An official record listing  the  destruc-
14    tive device or bomb destroyed and the location of destruction shall be kept on
15    file  at the office of the seizing agency. In the event of such destruction, a
16    photograph, videotape, or similar record of the device or bomb shall  be  pre-
17    served  for  evidentiary  purposes. The destruction of a destructive device or
18    bomb before a preliminary hearing, trial, or both shall not be a bar to prose-
19    cution for any violation of law.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS 08478

This legislation promotes public safety in that it provides for the destruction of bombs
and other explosive devices which have been lawfully seized by a law enforcement
agency. The failure to dispose of these bombs in a safe fashion presents a threat to-law
enforcement personnel as well as to the public at large. The legislation also requires
recording information to preserve a record of the bomb, its destruction, as well as other
evidence which may later be required in trial.

                            FISCAL NOTE

There is no fiscal impact on the state general fund.
