                                   SENATE BILL NO. 1047

                             BY JUDICIARY AND RULES COMMITTEE

 1                                        AN ACT
 2    RELATING TO ANIMALS; AMENDING SECTION 25-1910, IDAHO CODE,  TO  PROVIDE  CIVIL
 3        AND  CRIMINAL   DAMAGES  UPON  THEFT OR UNLAWFUL DESTRUCTION OF FURBEARING
 4        ANIMALS USED FOR COMMERCIAL PURPOSES OR RECORDS PERTAINING THERETO.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 25-1910, Idaho Code, be, and the same  is  hereby
 7    amended to read as follows:

 8        25-1910.  CIVIL  DAMAGES    AND  OTHER PENALTIES  UPON THEFT OR
 9    UNLAWFUL DESTRUCTION OF  FURBEARING ANIMALS RAISED  FOR  COMMERCIAL  PUR-
10    POSES OR  LIVESTOCK.  (1)  In addition to the criminal penal-
11    ties that may be imposed upon a person convicted of theft or unlawful destruc-
12    tion  of    furbearing  animals  raised for commercial purposes or 
13    livestock, the court shall assess civil damages against the defendant  in  any
14    amount necessary to fully compensate the owner of the  furbearing animals
15    raised  for commercial purposes or  livestock for his loss, which amount
16    shall be paid to the owner, and any amount necessary to fully  compensate  any
17    trade  association which has paid out rewards which led to the arrest and con-
18    viction of the defendant in the particular case, which amount shall be paid to
19    the trade association.
20         (2)  Any person who intentionally  and  without  permission  of  the
21    owner releases any furbearing animals raised for commercial purposes is guilty
22    of  a  felony  and the court may assess civil damages against the defendant in
23    any amount necessary to compensate the owner of the furbearing animals  raised
24    for  commercial purposes.  Additionally, any person who intentionally destroys
25    or conspires to destroy any paper or electronic record of a furbearing  animal
26    raised  for  commercial purposes shall be guilty of a felony and the court may
27    assess civil damages against the defendant in any amount necessary to  compen-
28    sate  the  owner  of  the  furbearing  animals raised for commercial purposes.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS08577

The purpose of this legislation is to amend Section 25-1910, Idaho Code, to provide
civil and criminal damages upon theft or unlawful destruction of furbearing animals
used for commercial purposes or records pertaining thereto.

                          FISCAL IMPACT

There may an undetermined affect to the General Fund and local budgets should
this bill result in the incarceration of persons performing unlawful acts.
